Bear Cub Rescued After Head Gets Stuck Inside Tin Box Near Amarnath Cave

A bear cub was Saturday rescued after its head was trapped inside a tin box near the Amarnath cave shrine in south Kashmir Himalayas, officials said.

The baby bear came down from the upper reaches of the holy cave on Friday night with its head trapped in a tin box, the officials said.

On Saturday early morning, a joint team of Jammu and Kashmir Police, State Disaster Response Force, National Disaster Response Force, and the wildlife department made several attempts to rescue the cub even as its mother was lurking around, they said.

However, after a few attempts, the mother bear was shooed away and the cub was overpowered, the officials said.

A cutter was used to cut open the tin box and the cub was finally freed. Due care was taken by the rescuers to avoid any injuries to the cub, they said.

After the rescue operation, the cub reunited with its mother and the duo fled towards the mountains, the officials added.

सरकार के पहल बाद घटे टमाटर के दाम, जानें कहां मिली राहत

नई दिल्ली: सस्ते टमाटर के लिए सड़के से लेकर ऑनलाइन तक मारामारी मची है. अभ हर कोई सस्ते टमाटर के लिए तड़प रहा है. पिछले एक महीने से सरकार के लगातार हस्तक्षेप के कारण लगभग सभी स्थानों पर कीमतों में लगातार गिरावट आ रही है. आज दिल्ली-एनसीआर में 85 मोबाइल वैन तैनात की गईं.

नोएडा के 15 स्थानों के अलावा दिल्ली के सभी विधानसभा क्षेत्रों में सस्ते टमाटर को लेकर मोबाइल वैन तैनात की गई.
 इसी तरह राजस्थान और यूपी में भी सस्ते टमाटर को लेकर मोबाइल वैन तैनात किया गया. इसका थोक बाजार कीमतों और खुदरा कीमतों दोनों को स्थिर करने में सकारात्मक प्रभाव पड़ा है.

टमाटर का ताजा भाव 
लखनऊ- थोक 70-80, खुदरा 80-100 रुपए प्रति किलो
कानपुर- थोक 50-60, खुदरा 80-100 रुपए प्रति किलो
वाराणसी- थोक 70-80, खुदरा 90-100 रुपए प्रति किलो
जयपुर- थोक 65-70, खुदरा 90-100 रुपए प्रति किलो
दिल्ली- थोक 70-80, खुदरा 80-120 रुपए प्रति किलो

फिलहाल केंद्र की तरफ से 70 रुपए टमाटर बेचा जा रहा है. इसकी इतनी ज्यादा डिमांड है कि आज मात्र 7 मिनट में 3000 किलो टमाटर ऑनलाइन बुकिंग हुई. महाराष्ट्र और कर्नाटक में टमाटर की फसल खराब होने से बाजार में दाम दो सौ रुपए किलो तक पहुंच गए हैं.

विदेश भेजने के नाम पर ठगी! मुंबई में फर्जी कॉल सेंटर का पर्दाफाश, 12 गिरफ्तार

मुंबई क्राइम ब्रांच यूनिट 8 ने एक कॉल सेंटर का पर्दाफाश किया है, जहां से विदेशों का सस्ता हवाई टिकट देने के नाम पर ठगी की जा रही थी. क्राइम ब्रांच डीसीपी राजतिलक रोशन ने बताया कि  सूचना मिलने पर मुंबई क्राइम ब्रांच यूनिट 8 की टीम ने अंधेरी में चल रहे कॉल सेंटर पर छापा मारकर 12 लोगों को गिरफ्तार किया है.

पुलिस के मुताबिक ये गिरोह सोशल मीडिया प्लेटफार्म के जरिए लोगों को विदेश का सस्ता हवाई टिकट देने का लालच देते थे, जो इनके साइट पर जाता उससे पैसे भरवा कर फर्जी या होल्ड टिकट देकर उसका नंबर ब्लॉक करवा देते थे. ये गिरोह पिछले 6 महीने से मुंबई में ठगी करता आ रहा था.

पुलिस के मुताबिक गिरोह ने ज्यादातर कनाडा जाने की चाह रखने वाले लोगों को ठगा है. पुलिस ने कॉल सेंटर से 28 लैपटॉप , 40 मोबाइल फोन और 2 राउटर जब्त किए हैं. फिलहाल पुलिस इस पूरे मामले की जांच कर रही है.

हरियाणा: पलवल में होने वाली महापंचायत के मद्देनजर नूंह में ड्यूटी मजिस्ट्रेट नियुक्त किए गए

ब्रजमंडल धार्मिक जलाभिषेक यात्रा के दौरान हुई हिंसा के विरोधस्वरूप विश्व हिन्दू परिषद, बजरंग दल व हिन्दू समुदाय की ओर से 13 अगस्त को गांव पौंडरी थाना हथीन, जिला पलवल में एक महापंचायत का आयोजन किया जा रहा है. इसके मद्देनजर कानून व्यवस्था बनाए रखने के लिए सीमा पर जिलाधीश एवं उपायुक्त धीरेंद्र खड़गटा ने ड्यूटी मजिस्ट्रेट नियुक्त किए हैं.

जिलाधीश की ओर से जारी किए गए आदेश में कहा गया है कि हिन्दू समुदाय द्वारा आयोजित होने वाली इस महापंचायत में जिला नूंह से हिन्दू समुदाय के लोगों के शामिल होने की संभावना है. कानून एवं व्यवस्था के लिए जिला नूंह, पलवल बार्डर के नजदीक गांव किरा थाना सदर नूंह में नाका लगाया गया है. 

हालात के मद्देनजर नरेंद्र सिंह कुंडू, एक्सईएन, पंचायती राज को नूंह-पलवल रोड किरा गांव में पुलिस नाका के पास तथा बिनेश कुमार, जिला, नगर योजनाकार को सोहना-पलवल सड़क गंगोली के पास ड्यूटी मजिस्ट्रेट तैनात किया गया है.  उपमंडल मजिस्ट्रेट, नूंह अपने संबंधित उपमंडल में कानून एवं व्यवस्था बनाए रखने के समग्र प्रभारी होंगे.

Adani Ports Accepts Resignation Of Firm Auditor Deloitte

Deloitte has resigned as auditor of the Adani Group's port company, with the firm run by billionaire Gautam Adani saying the auditor wanted a wider remit over other firms in the conglomerate.

In a statement, Adani Ports & Special Economic Zone (APSEZ) confirmed the resignation and appointment of M S K A & Associates as the new auditor.

Deloitte has been the auditor of APSEZ since 2017. In July 2022, it was given another five-year term.

"In Deloitte's recent meeting with APSEZ management and its Audit Committee, Deloitte indicated a lack of a wider audit role as auditors of other listed Adani portfolio companies. The Audit Committee was of the view that the grounds advanced by Deloitte for resignation as Statutory Auditor were not convincing or sufficient to warrant such a move," it said.

APSEZ conveyed that it was not within the remit of the firm and its Board to recommend group-wide appointments as other listed Adani portfolio companies are completely independent, with separate boards, executive teams and minority shareholders.

"Following this, Deloitte was not willing to continue as APSEZ's statutory auditor and, therefore, it was agreed to amicably end the client-auditor contractual relationship between APSEZ and Deloitte," it said.

APSEZ in a statement on Saturday said, "In response to a query by the Audit Committee, Deloitte confirmed that they have received all the APSEZ information from the management of the company. The same has been confirmed by Deloitte in their resignation letter dated August 12, 2023, to the company."

APSEZ said, "The 'other matters' highlighted in the auditor's resignation are adequately disclosed and addressed in our FY23 financial statements. We are fully confident that these matters will be appropriately resolved in our September'23 filing."

'अखंडा' की ब्लॉकबस्टर सफलता के बाद, मास मेकर बोयापति श्रीनु ने मास एक्शन एंटरटेनर 'स्कंद' के लिए उस्ताद राम पोथिनेनी के साथ जुगलबंदी की है. इस फिल्म में राम पोथिनेनी को बिल्कुल अलग रूप में पेश किया गया है. फिल्म के पोस्टर में भी राम पोथिनेनी को एकदम एक्शन अंदाज में देखा जा सकता है. टीम ने एक विशाल सेट पर लीड जोड़ी के साथ आखिरी गाने की शूटिंग खत्म की है. इसके साथ ही, स्कंद की पूरी शूटिंग खत्म हो गई है. फिल्म के सेट से लेटेस्ट फोटो में राम पोथिनेनी और श्रीलीला फैंसी ड्रेस में दिखाई दे रहे हैं और वे निर्देशक बोयापति श्रीनु और निर्माता श्रीनिवास चित्तूरी के साथ पोज दे रहे हैं

"Was Never Kind To Me": Himanta Sarma On Jairam Ramesh's "2 Sins" Charge

Assam Chief Minister and BJP's pointsperson in the northeast, Himanta Biswa Sarma, today snubbed the Congress - his former party - and hit back at its senior leader Jairam Ramesh who called him a result of "only two real sins" committed by the grand old party in the northeast.

"When I was in Congress, Jairam Ramesh was never kind to me. I was also never kind to him," he said in an exclusive conversation with NDTV's Editor-in-Chief Sanjay Pugalia as part of a special series to mark the 76th Independence Day.

"I always told Congress - you didn't give me anything. I gave the party a lot," he asserted.

On Tuesday, Congress general secretary Jairam Ramesh said there are "only two real sins" committed by the Congress in the northeast: "One committed by Hiteswar Saikia, to give respectability to a young man who formed part of the Surrendered ULFA. The other was by Tarun Gogoi, who gave this rank opportunist positions of power and authority."

The 54-year-old, once considered the blue-eyed boy of former Assam Chief Ministers Hiteswar Saikia and Tarun Gogoi, quit the Congress in 2015 after he fell out with Mr Gogoi.

"It's not like the Congress gave me a chance in politics. I proved it to even Gogoi sir that I was in Assam because I belong here and not due to him. Hiteswar Saikia didn't bring me into Congress. I got the entire Assam student community to join the party at his request. Because of that, I became a target for ULFA," said Mr Sarma in response to Mr Ramesh's charge.

Mr Sarma, an ardent critic of the Gandhis, added: "I don't believe Gandhis gave us anything. It's our sweat and blood that made the Gandhis. People say Rahul (Gandhi) or Rajiv (Gandhi) propped someone up. But it is the street soldier who gives his blood."

He also called Jairam Ramesh the courtier of Gandhis, who "ruled in Delhi": "The Gandhis ruled in Delhi and people like Jairam Ramesh are courtiers and courtiers don't know the reality of politics."

Himanta Biswa Sarma, who had deftly managed the 2006 and 2011 election campaigns for the party in Assam, joined the BJP in August 2015 following differences with the then Congress leadership.

Businessman Linked To Mumbai Covid Centre Scam Seeks To Withdraw Statement

Businessman Sujit Patkar, who is in judicial custody for alleged involvement in irregularities in obtaining contract to run jumbo COVID-19 treatment centres in Mumbai, on Thursday moved an application before a special court seeking to retract his statements claiming these were recorded by the Enforcement Directorate (ED) under "force, coercion and undue influence".

Patkar, reportedly a close aide of Shiv Sena (UBT) Rajya Sabha MP Sanjay Raut, is currently in judicial custody after being arrested in the case on July 19.

The application, moved through his lawyer Subash Jha, said during the probe the ED recorded his statement under duress, force, coercion and undue influence on July 21, 23, 24, 25 and 26.

"The statements which seek to implicate Patkar and other accused and have been recorded under duress, coercion, undue influence and force are retracted herewith and the same be not acted upon and/or read in evidence in any proceeding," the application said.

The plea said there were four partners in Lifeline Hospital Management Services, which got the contract to run the jumbo treatment centres, but only Patkar has been singled out and arrested as he is perceived to be close to certain politicians.

His arrest is "actuated by malafide and is politically motivated", the plea added.

As per the ED, Lifeline Hospital Management Services, which is a partnership firm of Patkar and three others established in June 2020, received Rs 31.84 crore from Brihanmumbai Municipal Corporation for supply of medical personnel to COVID centres.

The ED said the firm did not have any experience of providing medical personnel or services.

The probe agency has alleged Patkar received a substantial amount of the proceeds of crime from Lifeline Management Services in his personal bank account.

विपक्ष की गेंद, PM के शॉट : अविश्वास प्रस्ताव पर मोदी सरकार की ध्वनिमत से जीत

  1. पीएम मोदी ने कहा, "मजा इस डिबेट का देखिए...फील्डिंग विपक्ष ने ऑर्गनाइज की, लेकिन चौके-छक्के यहीं से लगे. विपक्ष नो-कॉन्फिडेंस पर नो बॉल कर रहा है और इधर से सेंचुरी हो रही है. आप तैयारी करके क्यों नहीं आते जी."
  2. उन्होंने कहा, "अविश्वास और घमंड इनकी रगों में रच-बस गया है. वे जनता के विश्वास को कभी देख नहीं पाते. ये जो शुतुरमुर्ग एप्रोच है, इसके लिए देश क्या कर सकता है." 
  3. पीएम ने कहा कि कांग्रेस की मुसीबत ऐसी है कि उन्हें खुद को जिंदा रखने के लिए इनको NDA का ही सहारा लेना पड़ा. लेकिन आदत के मुताबिक घमंड का जो आई (I) है, वह इनको छोड़ता नहीं है, इन्होंने NDA के साथ दो आई (I) जोड़ लिए हैं. पहला - 26 दलों का घमंड है, दूसरा- एक परिवार का घमंड है. पीएम ने कहा कि कांग्रेस ने NDA भी चुरा लिया, खुद बचने के लिए और इंडिया के भी टुकड़े (I.N.D.I.A.) कर दिए. 
  4. पीएम ने ये कहा- 'यूपीए को लगता है कि देश के नाम का इस्तेमाल कर विश्वसनीयता बढ़ाई जा सकती है. ये इंडिया गठबंधन नहीं है. ये घमंडिया गठबंधन है. इसकी बारात में हर कोई दूल्हा बनना चाहता है. सबको प्रधानमंत्री बनना है.
  5. विपक्ष के साथियों के प्रति अपनी संवेदना व्यक्त करता चाहता हूं, कुछ दिन पहले ही बेंगलुरु में आपने मिल-जुलकर करीब डेढ़-दो दशक पुराने UPA का क्रिया-कर्म किया है. उसका अंतिम संस्कार किया है. 
  6. पीएम मोदी ने कहा कि हमारे विपक्ष के साथियों का सबसे प्यारा नारा है- मोदी तेरी कब्र खुदेगी, लेकिन मेरे लिए इनकी ये गालियां, ये अपशब्द टॉनिक का काम करते हैं. विपक्ष के लोगों को एक रहस्यमयी वरदान मिला हुआ है कि जिसका भी ये लोग बुरा चाहेंगे उसका भला ही होगा.
  7. इससे पहले ज्योतिरादित्य सिंधिया ने विपक्षी गठबंधन पर निशाना साधा. उन्होंने कहा, "विचित्र स्थिति है कि जिनके दिल नहीं मिलते, वो दल मिल चुके हैं. जिनके इतिहास में वैचारिक या व्यावहारिक या सैद्धांतिक संबंध ना हो, वो लोकसभा चुनाव के लिए एक साथ आए हैं और लोकतंत्र बचाओ की बात कर रहे हैं."
  8.  ज्योतिरादित्य सिंधिया ने बुधवार को राहुल गांधी के मणिपुर पर दिए गए भाषण पर आपत्ति जाहिर की. उन्होंने कहा, "कल राहुल गांधी ने कहा कि प्रधानमंत्री के लिए मणिपुर भारत का हिस्सा नहीं है. प्रधानमंत्री ने पूर्वोत्तर को दुनिया से जोड़ा है, उनका पूर्वोत्तर से गहरा रिश्ता है. भारत को बांटकर देखने की विचारधारा आपकी है, हमारी नहीं." 
  9. वहीं, लोकसभा में वित्त मंत्री निर्मला सीतारमण ने कहा- 'बनेगा, मिलेगा' जैसे शब्द अब प्रचलन में नहीं हैं. आजकल लोग बन गए, मिल गए का उपयोग करते हैं. बिजली आएगी... अब बिजली आ गई, गैस कनेक्शन मिलेगा.. अब गैस कनेक्शन मिल गया, एयरपोर्ट बनेगा... अब एयरपोर्ट बन गया. 
  10. अविश्वास प्रस्ताव पर चर्चा के दौरान लोकसभा में निर्मला सीतारमण ने कहा, 'हमने बैंकिंग सेक्टर को बेहतर करने के लिए कई कदम उठाए हैं. बैंक अब राजनीतिक हस्तक्षेप के बिना काम कर रहे हैं. बैंकों में फैलाया UPA का रायता हम साफ कर रहे हैं.'

2 Women Sexually Assaulted At Cop Training School Near Mumbai, 2 Arrested

The police have arrested two poeple, including a woman, for allegedly sexually assaulting two women who attended classes at a police training academy in Nalasopara near Mumbai, an official said.

The arrests were made by the Mira Bhayandar-Vasai Virar police on Wednesday based on a complaint filed by the women, he said.

"The accused, Samadhan Gawade, runs a police training academy at Nalasopara. The two women were undergoing training at the institute," the official from the Nalasopara police station said.

It came to light that Gawade allegedly sexually assaulted them inside the classroom and the woman helped him by providing information about the women, he said.

"Fed up with the harassment, the two women stopped going to the academy. They informed their family about it, following which a complaint was lodged," the official said.

A case was registered under Indian Penal Code (IPC) sections 345 (wrongful confinement), 354D (stalking) and under the Protection of Children from Sexual Offences (POCSO) ACT as well as the Information Technology Act was registered against the two, he said.

Further investigation is on, the police said.

Himachal Chief Minister's Helicopter Makes Emergency Landing In Shimla

Himachal Pradesh's Chief Minister Sukhvinder Singh Sukhu's chopper made an emergency landing about 500-700 metres away from the landing point in Bithal area of Rampur subdivision in Shimla on Thursday.

The chief minister, who was accompanied by Public Works Department (PWD) minister Vikramaditya Singh and Former State Congress Chief and MLA from Theog Kuldeep Rathore, has taken the flight from Shimla and was scheduled to land at a helipad in the campus of JSW Power Company in Bithal.

"There was some issue with the air pressure which compelled the pilot to land the chopper in farmlands about 500 metres away from the landing point," officials in the Chief Minister office told the PTI on Thursday.

The Chief Minister and others are safe, he added.

Later, Chief Minister Sukhu visited the rain-affected Kharahan area in Rampur and announced to provide compensation of Rs one lakh each to all those whose houses were partially damaged and stated that the government was considering enhancing the relief amount to those whose houses have been completely destroyed.

"I am pained that the opposition was doing politics during the hours of the disaster and seeking it as an opportunity to remain in news," Mr Sukhu said.

"The government believes in serving the people without any motive or political gains and we are working for the welfare of the people," he said in a statement issued in Shimla.

"UPA's Character Is To Indulge In Corruption To Save...": Amit Shah

Home Minister Amit Shah on Wednesday questioned the character of the opposition alliance, saying its true face was seen when it indulged in corruption to save its governments.

Intervening in the debate on the no-confidence motion against the government, Mr Shah in Lok Sabha said when the then prime minister Atal Bihari Vajpayee faced a no-trust vote in 1999, he chose to step down instead of indulging in corruption to save his government.

"The character of political parties and alliances is revealed in such times of crises. UPA's character is to indulge in corruption to save the government by hook or by crook, while the BJP-led NDA's character is to stand up to the principles," Shah said.

He said the then prime minister P V Narasimha Rao had faced a no-confidence motion in 1993 and the Congress then chose to remain in power by hook or by crook.

"Narasimha Rao won the trust vote, but Jharkhand Mukti Morcha (JMM) members had to go to jail. Later, Narasimha Rao also went to jail... today, the Congress and the JMM are sitting in the opposition in the Lok Sabha," he said.

"In 2008, Manmohan (Singh) ji brought the confidence motion, this House saw its most disgraceful moments when MPs were bribed in crores of rupees and the government was saved. This is the character of the UPA," the BJP leader said.

Mr Shah said opposition parties do not have confidence in the government, but the people of the nation think otherwise.

"Post independence, if the nation has confidence in any leader, it is Narendra Modi who was elected twice with complete majority. After 30 years, people elected a full majority government," the minister said.

Mr Shah said he had heard the speeches of opposition leaders and has reached the conclusion that this no-confidence motion was brought in the House only to create confusion.

On the Quit India movement's anniversary, the prime minister has given the slogan -- 'Corruption Quit India, Dynasty Quit India and Appeasement Quit India', he said.

"Modi has ushered in a new era of politics since 2014, that of development which will lead to the creation of India of the dreams of our freedom fighters much before 2047," the home minister said.

Lok Sabha Adopts Resolution Appealing For Peace In Manipur

The Lok Sabha on Wednesday adopted a resolution appealing for peace in Manipur, with NDA members enthusiastically supporting it in the presence of the opposition.

As Home Minister Amit Shah concluded his intervention on the no-confidence motion in the House, he suggested that Speaker Om Birla read out a resolution appealing for peace in Manipur.

The suggestion made by Mr. Shah, who spoke extensively on the Manipur situation in Lok Sabha, was supported by Deputy Leader of the House and Defence Minister Rajnath Singh.

Congress leader in Lok Sabha Adhir Ranjan Chowdhury said first a draft of the resolution should be shared and it should be adopted in the presence of Prime Minister Narendra Modi on Thursday.

Mr. Birla then read out the resolution which was adopted by the House.

On Outcry Over Bilkis Bano's Rapists Walking Free, Supreme Court Says...

Public outcry will not affect judicial decisions, the Supreme Court asserted on Tuesday, as it began weighing the legality of the remission granted to all the 11 convicts in the Bilkis Bano gang-rape case and murder of seven of her family members during the 2002 Gujarat riots.

A bench of Justices BV Nagarathna and Ujjal Bhuyan made it clear that agitations and society's outcry will not have an effect on its decisions and that it will go only by the law.

"Public outcry will not affect our judicial decisions. We will consider only legal submissions and will not go by this (public anger over the incident). Suppose, there is no public outcry. Are we supposed to uphold the order? If there is a public outcry, does it mean it is a wrong order?" the bench told advocate Shobha Gupta, appearing for Bilkis Bano.

The observation came after Ms Gupta submitted that "public outcry" is one of the important factors to be considered while granting remission to convicts.

She said there was an outcry in society after the convicts in the case were released and there were agitations across the country.

As the hearing began on Tuesday, Bilkis Bano's counsel told the top court the Additional Director General of Police, Prisons and Correctional Administration, Gujarat had tendered a negative opinion about remission to the convicts and not recommended premature release of one of them - Radheshyam Shah.

She told the bench that after Radheshyam Shah's plea seeking premature release under the Gujarat government's July 9, 1992 policy on remission was declined by the Gujarat High Court, he approached the top court in a writ petition for relief.

"How is this writ petition before this court maintainable after he has already availed remedy under Article 226 (before HC), accepted order and acted on it? For what purpose did he come to this court, and how did this court entertain the petition?" he bench asked.

Article 226 gives high courts the power to issue instructions, orders, and writs to any person or authority, including the government.

Radheysham Shah had moved the Supreme Court seeking remission on the ground that he had completed 15 years and 4 months in jail. He was sent to life imprisonment by a CBI court in Mumbai in 2008. In accordance with the rules then in force, a convict could apply for remission after 14 years, which was then considered the period of life imprisonment.

Hearing Shah's petition, the court had asked the Gujarat government to look into the matter and decide within two months whether he could be granted remission.

Bilkis Bano's counsel Gupta submitted that after the Supreme Court order directing the Gujarat government to consider his plea, everything got expedited and all the convicts got released on August 15, 2022.

Senior advocate Indira Jaising, appearing in one of the PILs, recalled how the convicts were garlanded and felicitated and statements were made about their being Brahmins who cannot commit crimes.

Additional Solicitor General SV Raju said those who garlanded the released convicts were their family members. "What is wrong in garlanding by a family member?" he asked.

At the fag end of the hearing on Tuesday, the top court said it will hear arguments on August 9 on the locus standi of multiple people who have filed PILs in the Bilkis Bano gang-rape case.

Besides the petition filed by Bilkis Bano, several other PILs including one by CPI(M) leader Subhashini Ali, independent journalist Revati Laul and former vice-chancellor of Lucknow University Roop Rekha Verma have challenged the remission. Trinamool Congress (TMC) MP Mahua Moitra has also filed a PIL against the remission.

Senior advocate Sidharth Luthra, appearing for one of the convicts, told the bench that once the victim individual is in court, others may not have a locus standi (entitlement to bring a lawsuit in court) to intervene in the matter of this nature.

The convicts in the Bilkis Bano gang-rape case and murder of seven of her family members during the 2002 Gujarat riots chased her with a "blood thirsty approach" to hunt Muslims and kill them, the top court was told on Monday, as it commenced the final hearing on a batch of pleas challenging the remission granted last year to all the 11 convicts in the case.

The top court had on April 18 questioned the Gujarat government over the remission granted to the 11 convicts, saying the gravity of the offence should have been considered before showing leniency, and wondered if there was any application of mind. All of them had walked free on August 15, 2022.

Asking for reasons for the premature release of the convicts, the top court had also questioned frequent parole granted to them during their incarceration.

"It (remission) is a kind of grace, which should be proportional to the crime," it had said.

Terming Bilkis Bano's gang-rape and the murder of her family members a "horrendous" act, the top court had on March 27 asked the Gujarat government whether uniform standards, as followed in other murder cases, were applied while granting remission to the convicts.

Bilkis Bano was 21 and five months pregnant when she was gang-raped while fleeing the communal riots that broke out after the Godhra train-burning incident. Her three-year-old daughter was among the seven family members killed in the riots.

The 11 convicts granted premature release are Jaswantbhai Nai, Govindbhai Nai, Shailesh Bhatt, Radheshyam Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Mordhiya, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt, and Ramesh Chandana.

Father Of 4 Girls, Maharashtra Man Kidnaps Boy As He Wanted A Son

A 32-year-old father of four girls has been arrested for allegedly kidnapping a 4-year-old boy at Maharashtra's Kalyan station in his desperate attempt to have a "son", an official said on Tuesday.

Nashik resident Kachru Waghmare, alias Bala, allegedly committed the crime on Monday morning when the child was playing outside the waiting area at the station, on the outskirts of Mumbai.

The official said Waghmare, a daily wager, left the station premises with the child. He went around Kalyan city, bought food and sweets for the child and returned to the station to board a train to Jalna, some 350 km away.

Meanwhile, the boy's father approached the Government Railway Police (GRP) saying his son had gone missing.

The GRP registered a first information report (FIR) and began scanning the footage of the CCTV cameras installed on the station premises. The footage showed Waghmare moving with the boy.

GRP arrested Waghmare when he returned to the station, the official said, adding that he was planning to board a train to Jalna.

"Waghmare has four daughters. He said he was desperate to have a son so he kidnapped the child," the official said.

Delhi Services Bill "Perfectly Valid": Ex Chief Justice Of India

Former Chief Justice of India and Rajya Sabha MP Ranjan Gogoi on Monday said the bill to replace an ordinance for handling the transfers and postings of officials in the Delhi government is "perfectly, legitimately valid".

Home Minister Amit Shah introduced the Government of National Capital Territory of Delhi (Amendment) Bill, 2023 for consideration in the Rajya Sabha.

The bill has been passed by both the Houses of parliament.

Participating in the debate on the bill, Mr Gogoi, a nominated member of the Upper House, said it is the prerogative and the right of the members of the House to debate, and the question of the proposed legislation being sub-judice does not arise.

Several leaders from the opposition parties have termed the Delhi services bill as "unconstitutional". Some even suggested that Parliament should not take up the bill saying the matter was pending before the Supreme Court.

"So far as overreaching or outreaching the order of the court, Supreme Court, is concerned, very shortly put the position in my perception is this. The state legislature makes laws for the states. Parliament makes laws for the Union Territories," he said in his maiden speech in the House.

He said for the National Capital Region of Delhi, which has a special status, the state legislature or the legislature of Delhi makes the laws on state subjects except three matters.

But as pointed by Mahesh Jethmalani (BJP), Mr Gogoi said Parliament has the power to frame laws beyond the three matters and that is exactly what the bill is seeking to do.

"Therefore, there is no question of overreaching," he said.

Mr Gogoi further said there is "absolute freedom" of speech in Parliament and whatever a member says in Parliament cannot be questioned in a court of law.

The former chief justice of India spoke on various aspects of the bill and other law points, and asserted that "...in my respectful submission, my contention, Bill is perfectly, legitimately valid".

According to the bill, the National Capital Civil Services Authority will consist of the chief minister, chief secretary and the principal home secretary of Delhi.

The bill empowers the authority to make recommendations to the Delhi lieutenant governor regarding transfers and postings of officials and disciplinary matters.

It also empowers the LG to exercise his sole discretion on several matters, including those recommended by the National Capital Civil Services Authority, and the summoning, prorogation and dissolution of the Delhi Legislative Assembly.

Lok Sabha To Take Up Digital Personal Data Protection Bill Tomorrow

The Lok Sabha is to take up the Digital Personal Data Protection (DPDP) Bill, 2023 on Monday for consideration and passing.

Earlier on August 3, Union Communications, Electronics and Information Technology Minister Ashwini Vaishnaw introduced Digital Personal Data Protection Bill, 2023, in the Lok Sabha.

Opposition members strongly opposed the introduction of the bill and said that the bill violates the fundamental right to privacy. They demanded that the bill should be sent to the standing committee for scrutiny. They said the government had withdrawn a bill on data protection last year and the new bill needs more scrutiny.

Mr Vaishnaw said that it is not a money bill and all issues raised by the opposition will be answered during the debate.

The Bill provides for the processing of digital personal data in a manner "that recognises both the right of individuals to protect their personal data and the need to process such personal data for lawful purposes".

In view of the feedback from stakeholders and various agencies, the Bill was withdrawn in August 2022. On November 18, 2022, the government published a new draft Bill, titled the Digital Personal Data Protection Bill 2022, and initiated a public consultation on this draft.

A comprehensive and detailed consultation was held on this subject. 21,666 comments were received from the public and a series of consultations were held with 46 sector organisations, associations and industry bodies.

Comments were also received from 38 ministries/departments of the Government of India. The reintroduced draft Digital Personal Data Protection Bill 2022 proposed six types of penalties on non-companies to companies.

To prevent a personal data breach, a penalty of up to Rs 250 crore is being proposed in the draft bill which was put out for public comments. Besides, failure to notify the Board and affected Data Principals in the event of a personal data breach and non-fulfilment of additional obligations in relation to children may attract a penalty of up to Rs 200 crore.

Non-fulfilment of additional obligations of Significant Data Fiduciary under sections 11 and 16 of the Act may attract Rs 150 crore and Rs 10 crore fines, respectively.

Lastly, non-compliance with provisions of this Act other than those listed in (1) to (5) and any rule made thereunder will attract penalties up to Rs 50 crore. Points that emerged in the course of consultations and comments were thoroughly studied and the draft Digital Personal Data Protection Bill 2023 was finalised.

The purpose of this Act, the draft said, is to provide for the processing of digital personal data in a manner that recognizes both the right of individuals to protect their personal data and the need to process personal data for lawful purposes.

During the drafting of the Personal Data Protection Bill in 2019, the government said that the entire gamut of principles was widely debated and discussed. These include the rights of individuals, duties of entities processing personal data and regulatory framework, among others.

The first principle of the proposed Bill is that usage of personal data by organisations must be done in a manner that is lawful, fair to the individuals concerned and transparent. The second principle of purpose limitation is that the personal data is used for the purposes for which it was collected.

The third principle of data minimisation is that only those items of personal data required for attaining a specific purpose must be collected. Among others, personal data should be limited to such duration as is necessary for the stated purpose for which personal data was collected and reasonable safeguards to ensure that there is no unauthorised collection or processing of personal data are some features.

"Surveillance Of Citizens": Editors Guild's On Data Protection Bill

The Editors Guild of India on Sunday expressed concerns over certain provisions of the Digital Personal Data Protection (DPDP) Bill, saying they can have an adverse impact on press freedom.

In a statement, the Guild said the DPDP Bill creates an enabling framework for surveillance of citizens, including journalists and their sources.

The Guild has asked Lok Sabha Speaker Om Birla to refer the Bill to a parliamentary standing committee. It has also written about its concerns on the Bill to Prime Minister Narendra Modi, Rajya Sabha Chairman Jagdeep Dhankhar, IT Minister Ashwini Vaishnaw and leaders of political parties in Parliament.

The government tabled the DPDP Bill in Lok Sabha on August 3 with an aim to protect the privacy of Indian citizens while proposing a penalty of up to Rs 250 crore on entities for misusing or failing to protect digital data of individuals.

The Bill comes six years after the Supreme Court held that right to privacy is a fundamental right.

Under Section 36 of the DPDP Bill, the Guild said, the government can ask any public or private entity (data fiduciary) to furnish personal information of citizens, including journalists and their sources.

It also voiced concerns over clause 17(2)(a) that allows the Union government to issue a notification exempting any "instrumentality of the State" from the provisions of this Bill, thereby out of the ambit of data protection restrictions, including internal sharing and processing of data.

Section 17(4) allows the government and its instrumentalities to retain personal data for an unlimited period of time, it added.

"We note, with dismay, that while the Bill, ostensibly to promote data protection, has failed to make any provisions that bring about the surveillance reform that is urgently needed, and in fact creates an enabling framework for surveillance of citizens, including journalists and their sources," the Guild said.

It said it is deeply concerned about the lack of exemptions for journalists from certain obligations of the law where the reporting on certain entities in public interest may conflict with their right to personal data protection.

The Justice Srikrishna Committee had provided a framework for balance between personal data protection and public interest, which is missing from the current bill, it said.

"This will lead to a chilling effect on journalistic activity in the country," the Guild said.

It said certain provisions of the Bill also shift the balance in favour of non-disclosure of information, including information sought by journalists in public interest, thereby reducing accountability.

The Guild has also flagged concerns over the composition of the Data Protection Board and stressed the need for it to be independent of the government.

The government has listed the DPDP Bill for consideration and passage in Lok Sabha on Monday.

Editors Guild "Deeply Concerned" About New Press And Periodicals Bill

The Editors Guild of India on Sunday voiced deep concerns about certain "draconian powers" in the Press and Registration of Periodicals Bill that grant government powers to have more intrusive and arbitrary checks into the functioning of newspapers and magazines.

In a statement, the Guild demanded that the Press and Registration of Periodicals (PRP) Bill, which seeks to replace the Press and Registration of Books Act-1867, be referred to a Parliamentary Select Committee.

The Guild is concerned about the expansion of powers of the Press Registrar, the new restrictions on citizens to bring out periodicals, the continuation of power to enter premises of news publications, the vagueness inherent in many of the provisions, and the ambiguity surrounding power to frame rules that can have adverse implications on press freedom, a statement by the Guild said.

The Guild has already written to Prime Minister Narendra Modi, Lok Sabha Speaker Om Birla, Rajya Sabha Chairman Jagdeep Dhankhar, leaders of political parties, as well as Information and Broadcasting Minister Anurag Thakur highlighting concerns over the Bill.

"Given the liberal and arbitrary use of UAPA - which is the basis for defining 'terrorist act' and 'unlawful activity' - as well as other criminal laws, including sedition, against journalists and media organisations to suppress freedom of speech, the Guild is deeply concerned by the introduction of these new provisions and the way they can be misused to deny the right to bring out news publications to persons who are critical of governments," it said.

It urged that only the Press Registrar should be the relevant authority for the purpose of this Act and no other government agency should be given any powers with respect to registration of periodicals.

"The law on this issue should be more respectful of freedom of the press and should avoid granting vast powers to regulatory authorities to either interfere or shut down the press at their whims and fancies," the Guild said, asserting that the primary emphasis of the Registrar and the PRP remains "registration" and not "regulation".

The PRP Bill was introduced in the Rajya Sabha on August 1 and passed two days later.
