Probe Agency Can't Peep Into Private Life Of Accused On Bail: Top Court

The Supreme Court on Monday held that bail conditions allowing an investigating agency to continuously track the movements of an accused violate the right to privacy guaranteed under Article 21 of the Constitution.

A bench of Justices Abhay S Oka and Ujjal Bhuyan, which deleted a bail condition imposed on Nigerian national Frank Vitus in a drugs case that mandated him to drop a PIN on the Google map to ensure that his location is available to the investigation officer of the case, said this court has held that bail conditions cannot be "fanciful, arbitrary or freakish".

The bench said, "The investigating agency cannot be permitted to continuously peep into the private life of the accused enlarged on bail, by imposing arbitrary conditions since that will violate the right of privacy of the accused, as guaranteed by Article 21." It said if a constant vigil is kept on every movement of the accused released on bail by the use of technology or otherwise, it will infringe the rights of the accused guaranteed under Article 21, including the right to privacy.

"The reason is that the effect of keeping such constant vigil on the accused by imposing drastic bail conditions will amount to keeping the accused in some kind of confinement even after he is released on bail. Such a condition cannot be a condition of bail," it said.

The bench said imposing any bail condition which enables the police/investigation agency to track every movement of the accused released on bail by using any technology or otherwise would undoubtedly violate the right to privacy guaranteed under Article 21.

"In this case, the condition of dropping a PIN on Google Maps has been incorporated without even considering the technical effect of dropping a PIN and the relevance of the said condition as a condition of bail. This cannot be a condition of bail. The condition deserves to be deleted and ordered accordingly," it said.

The court said in the case at hand, it is dealing with a case of the accused whose guilt is yet to be established and so long as he is not held guilty, the presumption of innocence is applicable.

"He cannot be deprived of all his rights guaranteed under Article 21. The courts must show restraint while imposing bail conditions. Therefore, while granting bail, the courts can curtail the freedom of the accused only to the extent required for imposing the bail conditions warranted by law," the bench said in its order, which was reserved on April 29.

Underscoring that bail conditions cannot be so onerous as to frustrate the order of bail itself, the bench said the court may impose a condition of periodically reporting to the police station/court or not travelling abroad without prior permission.

"Where circumstances require, the court may impose a condition restraining an accused from entering a particular area to protect the prosecution witnesses or the victims. But the court cannot impose a condition on the accused to keep the police constantly informed about his movement from one place to another. The object of the bail condition cannot be to keep a constant vigil on the movements of the accused enlarged on bail," it said.

The top court said the accused is bound by the conditions imposed while granting bail and if he, after being enlarged on bail, commits a breach of bail conditions or commits any offence, the courts always have the power to cancel the bail.

"A condition cannot be imposed while granting bail which is impossible for the accused to comply with. If such a condition is imposed, it will deprive an accused of bail, though he is otherwise entitled to it," it said.

It added that the object of imposing conditions of bail is to ensure that the accused does not interfere or obstruct the investigation in any manner, remains available for the investigation, does not tamper with or destroy evidence, does not commit any offence, remains regularly present before the trial court, and does not create obstacles in the expeditious conclusion of the trial.

"The courts have imposed a condition that the accused should cooperate with the investigation when bail is granted before filing the final report or charge sheet. Cooperating with the investigation does not mean that the accused must confess," it said, adding that the bail conditions must be consistent with the object of imposing conditions.

While imposing bail conditions, the constitutional rights of an accused, who is ordered to be released on bail, can be curtailed only to the minimum extent required, it said.

"Even an accused convicted by a competent Court and undergoing a sentence in prison is not deprived of all his rights guaranteed by Article 21 of the Constitution," the bench pointed out.

The top court also deleted another condition imposed on Victus by the Delhi High Court that he will have to obtain a certificate from the Embassy/High Commission of Nigeria that he shall not leave the country and shall appear before the court as and when required in the Narcotic Drugs and Psychotropic Substances Act case.

Victus was arrested on May 21, 2014 in the case and was released on bail on May 31, 2022 subject to various terms and conditions incorporated in the said order.

He moved the Supreme Court challenging the twin conditions imposed by the high court – sharing of Google PIN location with the investigating officer and obtaining a certificate from the embassy.

'Catch Me If You Can': How UP Gang Swindled Crores By Forging Cheques

In the 2002 hit Hollywood film "Catch Me If You Can", Leonardo DiCaprio plays the role of a conman in the late 1960s who makes millions of dollars by forging cheques.

Cut to now and a 10-member gang in Uttar Pradesh used the same modus operandi to swindle people of crores of rupees, only its techniques being a bit more sophisticated than those used in the film by Frank Abagnale Jr, the character played by DiCaprio.

The gang's members were arrested on Saturday by the Bulandshahr district police for scamming people across the country of crores of rupees by "cloning cheques", Senior Superintendent of Police (SSP) Shlok Kumar told PTI.

"Of those arrested, was a bank's generator operator who leaked data, a customer agent of a leading telecom company who transferred SIM cards (using fraudulent means) and a person whose accounts were used to deposit funds," Mr Kumar said.

Explaining their modus operandi, he said they used to steal chequebooks ordered by customers before it reached them from banks. When a customer lodged a complaint, the bank cancelled the previous chequebook and issued a new one, Mr Kumar said.

The gang's members used to get the details of the new chequebook from their accomplices before it was delivered to a customer, the SSP said.

After removing the details from the cheques of the cancelled chequebook using a chemical, the gang's members printed the details of the one delivered and received by the customer. They then put a forged signature of the customer on the cheques and withdrew money, the official said.

In the movie, Frank Abagnale, to make a counterfeit, used glue to stick symbols and stencils to get the lettering correct on a paper that had the dimensions similar to that of a genuine cheque.

SSP Kumar said an investigation was launched after a local lodged a complaint that Rs 15 lakh had been withdrawn from his account through a cheque not issued by him.

"The complainant said he did not receive any message from the bank. The man got to know that Rs 15 lakh had been withdrawn when he updated his passbook," the official said.

It was a well organised gang and its members worked in teams, each having a name like in a company or an office, the SSP said.

To swindle people, its members first acquired the know your customer details of a person from banks and then "for getting the SIM cards, they would produce forged documents of the person on whose name a number is allotted and show him or her as dead", Mr Kumar said.

"After that, this number would be purchased in the name of a new person so that any call or message from the bank would be attended by the accused and while posing as the bank account holder, verify fund transfers illegally started by them," he added.

Giving details of the units the gang was divided into, Mr Kumar said a "layering group" was involved in transferring the money received fraudulently into different bank accounts so that it became difficult for law enforcement agencies to trace and recover it.

"Then there was the 'asset creation group'. It was tasked with cleverly investing the ill-gotten money into making assets like purchasing land or property or other asset somewhere," he added.

Nitin Kashyap, Prem Shankar Vishwakarma, Awadhesh Kumar, Shah Alam, Uruj Alam, Bhupendra Kumar, Kalicharan, Alok Kumar, Brijesh Kumar and Chatar Singh have been arrested, police said.

Forty-two mobile-phones, 33 SIM cards, 12 chequebooks of various banks, 20 passbooks, 14 loose cheques have been seized from them, according to police.

The police have also impounded a car and recovered a "Delhi Police cap" which was kept on its dashboard. This gave an impression that they were police personnel and helped them skip security checks, they said.

"They used different phones to keep their identification concealed and evade police surveillance. They also carried walkie-talkies sets to communicate with each other," Mr Kumar said.

He said the gang was active in Delhi, Madhya Pradesh, Haryana, Chhattisgarh and Uttar Pradesh, among other places in the country.

This has been corroborated by the chequebooks and material seized, the SSP said.

Two of the 10 accused arrested are from Muzaffarnagar, where the police had declared a Rs 15,000 reward on their arrest after a similar fraud was committed by them in 2021, he said.

The accused have been sent into judicial custody by a local court, he added.

Woman Drowns, 3 Injured In Separate Incidents Due To Heavy Rain In Jammu

A woman drowned, and three people were injured in separate incidents as heavy rains lashed parts of Jammu overnight, officials said on Saturday.

The woman was identified as Rozi Kouser (30), they said.

Kouser's body was recovered from a stream in Keri Kangra in the Gursai area of Mendhar sub-division in Poonch district on Friday night, the officials said.

They said the cause of her death was not known immediately, but the area had witnessed heavy rains, and the woman might have slipped into the fast-flowing stream.

In another incident, three people were injured when their mud-house collapsed due to heavy rains at village Hansu in the Kotliwala area of Udhampur district, the officials said.

Heavy rains lashed parts of the Jammu region overnight, with Jammu city recording the highest 69.4 mm of rainfall, followed by 57.4 mm in the Udhampur district.

Katra, the base camp for the pilgrims visiting Mata Vaishno Devi shrine, recorded 50.1 mm and Kathua district 53.6 mm of rainfall, the official said.

The maximum temperature in Jammu was 30.9 degrees Celsius, which was 4.5 degrees below normal during this part of the season, the MeT spokesman said, adding that the minimum temperature was also 4.2 notches below normal at 21.6 degrees Celsius.

Authorities have issued an advisory in the Jammu region, asking people to avoid water bodies given the wet weather forecast by the Met Department till July 10.

Delhi Lt Governor Greenlights Probe Against Jailed AAP Leader In CCTV Case

Delhi Lt Governor VK Saxena approved the recommendation for a probe against jailed former Delhi minister Satyendar Jain in a graft case related to the installation of CCTVs in the city, Raj Niwas officials said today.

The ruling Aam Aadmi Party (AAP) alleged that the case against Mr Jain was part of the BJP's "relentless conspiracies" against it and the Delhi government. The BJP, on the other hand, said the sanction for an investigation "comes as no surprise" and it was expected long back.

In a statement, the AAP said, "The BJP is relentlessly engaging in sinister conspiracies against the Delhi government day and night to halt its works." It claimed that with "over 200 cases filed against AAP ministers and MLAs, and sending our top leadership, including Delhi Chief Minister (Arvind) Kejriwal to jail in just 10 years, this case is yet another step towards suppressing the AAP".

The BJP, however, described Mr Jain as a "master of corruption in the Delhi Cabinet".

Satyender Jain was arrested by the Enforcement Directorate (ED) in May 2022 in connection with a money laundering case. Currently, he is in judicial custody.

According to Raj Niwas officials, it has been alleged in the present case that Mr Jain received Rs 7 crore as a bribe for waiving a penalty of Rs 16 crore imposed on a company for a delay in the installation of CCTVs in 70 Assembly constituencies of Delhi.

VK Saxena agreed with the proposal of the Directorate of Vigilance to refer the matter under Section 17A of the Prevention of Corruption Act to the Union Home Ministry for approval of the investigation against Mr Jain by the Anti-Corruption Branch (ACB), they added.

Mr Jain was the Public Works Department minister and nodal authority of the project of installing 1.4 lakh CCTV cameras in Delhi at the cost of Rs 571 crore, officials said.

The case against Mr Jain is based on a September 2019 complaint by an employee of a company responsible for installing CCTV cameras. He alleged that the company arranged the bribe money through its vendors, officials said.

The ACB also obtained information from secret sources that corroborated the complainant, they said, adding the ACB had recorded the statement of the complainant.

In its statement, the AAP claimed that despite a large number of corruption cases lodged against its leaders, not a single penny has been recovered by the probe agencies.

"Ever since the AAP came to power (in Delhi), the BJP and its Central government have tried everything possible to undermine and paralyse it.

"This includes enacting the GNCTD Act against the Supreme Court's verdict and disrupting public interest initiatives through bureaucracy by withholding payments for Mohalla Clinics and medicines for government hospitals," it charged.

The party said that this is the 201st case against AAP leaders and "like the previous 200 cases, the BJP and its Central government are trying to paralyse the Delhi government because the AAP is a staunchly honest party".

The BJP's Delhi unit chief Virendra Sachdeva said the sanction for investigation into "kickbacks received by Mr Jain from the CCTV installation project was expected long back".

He thanked the Lt Governor for sanctioning the probe and said, "Till the day of his arrest in 2022, Satyendra Jain was master of corruption in the Delhi Cabinet. Therefore, the sanction of investigation against him comes as no surprise. It's shocking to note that the Arvind Kejriwal government has indulged in corruption even in projects related to women and children's security, be it in CCTV installation on roads in Delhi or installation of panic buttons in public transport vehicles," Mr Sachdeva said.

Assam Floods: 114 Wild Animals Dead In Kaziranga National Park, 95 Rescued

The devastating flood in Assam's famed Kaziranga National Park (KNP) has claimed the lives of 114 wild animals while 95 others have been rescued till Saturday, an official said.

The animal mortality in the KNP has increased from 77 till Friday.

The dead animals include four rhinos and 94 hog deer due to drowning in the KNP and 11 others during treatment.

The forest officials rescued 86 hog deer, two each of sambar deer and scops owl and one each of a rhino calf, Indian hare, otter, elephant and jungle cat, the KNP official said.

Currently, 34 animals are under medical care while 50 others have been released after treatment, the official said.

A hog deer was also killed after being hit by a speeding vehicle on a highway that runs through the KNP.

This is the worst deluge in terms of animal mortality in recent years in KNP.

An 18-month-old rhino calf which took shelter in the house of one Pushpanjali Sharma at Baghmari was subsequently rescued by members of the Centre for Wildlife Rehabilitation and Conservation.

''Our community is at the heart of our conservation efforts. These collaborative efforts in challenging times are what truly make us Awesome Assam'', Chief Minister Himanta Biswa Sarma posted on X about the incident.

Out of the total 233 camps in the Eastern Assam Wildlife Division, 66 were inundated as against 75 on Friday, the official said.

Forest department employees including security personnel stay in camps inside the national park to conduct patrolling for the protection of flora and fauna.

राष्ट्रीय जनता दल (राजद) के नेता तेजस्वी यादव ने शुक्रवार को नीतीश कुमार के नेतृत्व वाली बिहार सरकार पर नीट प्रश्नपत्र लीक घोटाले के लिए उन्हें दोषी ठहराने का प्रयास करने की आलोचना की. यादव ने सत्तारूढ़ राष्ट्रीय जनतांत्रिक गठबंधन (राजग) को चुनौती दी कि अगर सबूत हैं तो उन्हें ‘गिरफ्तार' करना चाहिए.

यादव ने ये टिप्पणियां राजद के गठन के 28 साल पूरे होने के अवसर पर आयोजित एक कार्यक्रम में कीं. उन्होंने सरकार पर भ्रष्टाचार और अपराध को बढ़ावा देने का आरोप लगाते हुए कहा, ‘‘यह सरकार डबल इंजन होने का दावा करती है. एक इंजन भ्रष्टाचार को बढ़ावा देता है, दूसरा अपराध को बढ़ावा देता है.''

पूर्व उपमुख्यमंत्री तेजस्वी यादव ने कहा, ‘‘राज्य में हर मुद्दे का दोष तेजस्वी के सिर मढ़ा जा रहा है, चाहे वह पेपर लीक हो, पुल ढहने का मामला हो या हत्या का. अगर सरकार के पास मेरे खिलाफ कोई सबूत है, तो उन्हें आरोप लगाने के बजाय मुझे गिरफ्तार करना चाहिए.''

राजग में शामिल जनता दल (यूनाइटेड) और भारतीय जनता पार्टी (भाजपा) के नेताओं ने इस बात पर जोर दिया है कि प्रश्न पत्र लीक मामले के एक प्रमुख संदिग्ध के यादव के निजी सहयोगी के साथ घनिष्ठ संबंध थे.

विपक्षी दल राजद ने राज्य के वरिष्ठ मंत्रियों के साथ अन्य प्रमुख संदिग्धों की तस्वीरें जारी करके जवाबी हमला किया है. प्रश्न पत्र लीक का खुलासा पिछले महीने पटना पुलिस द्वारा कई लोगों को गिरफ्तार करने के बाद हुआ था. मामले को अब केंद्रीय अन्वेषण ब्यूरो (सीबीआई) को सौंप दिया गया है.
