In India's 'Amritkaal', Country Has Come Out Of Mentality Of Slavery: PM

Prime Minister Narendra Modi on Thursday said for the first time in the 'Amritkaal' of India's independence, the country has come out of the mentality of slavery and is moving ahead with the feeling of pride for its heritage.

He was addressing the 'Mirabai Janmotsav', organised here to celebrate the 525th birth anniversary of the poet and Lord Krishna devotee.

"Today for the first time in the 'Amritkaal' of India's independence, the country has come out of the mentality of slavery, PM Modi said.

"We have taken the pledge of 'Panch Pran' from the Red Fort. We are moving ahead with the feeling of pride for our heritage," he said.

Mentioning Mirabai, he said, "Our country has always been the one that worships women power".

PM Modi also released a commemorative stamp and coin in the honour of Mirabai and attend a cultural programme, in which Hema Malini performed. Before attending the event, the prime minister paid obeisance at the Sri Krishna Janmabhoomi temple in Mathura.

Found Incriminating Papers Against Telangana Congress Leader: Probe Agency

Incriminating documents indicating "suspicious and unaccounted" transactions worth several crores of rupees were seized after searches were conducted against Congress candidate from Telangana's Chennur seat Vivek Venkatswamy, the Enforcement Directorate (ED) alleged on Wednesday.

The raids were launched under the Foreign Exchange Management Act (FEMA) on Tuesday at four locations, including the politician's residences in Hyderabad, office premises of his company Visaka Industries Ltd. in Hyderabad and that of Vigilance Security Services Pvt. Ltd. in Ramagundam, and his temporary place of residence at Hitech City in Mancherial district where he was present, the federal probe agency said in a statement.

With declared assets of more than Rs 600 crore, the 65-year-old former MP is the richest politician contesting the assembly polls in Telangana. The 119 assembly seats of the state will go to polls on November 30.

The former MP, early this month, had resigned from the BJP and joined the Congress in the presence of party leader Rahul Gandhi in Hyderabad. He had earlier been in the Congress from where he moved to the BRS of Telangana Chief Minister K Chandrasekhar Rao and then to the BJP.

The ED raids were triggered on the basis of a reference received from the Telangana Police to investigate a transaction of Rs 8 crore from the bank account of Vivek, also known as Dr Gaddam Vivekanand, to the company -- Vigilance Security.

The bank account of Vigilance Security was being used to "circuitously" transfer money with no real business rationale and Vivek, his wife and their company Visaka Industries had transactions of more than Rs 100 crore with Vigilance Security, the ED alleged.

Search operations resulted in the seizure of "digital devices, incriminating documents indicating suspicious and unaccounted transactions worth several crores as well as use of unaccounted cash in property deals," the ED said.  Seized documents also revealed large scale inter-corporate deposits within group companies having no legitimate business but holding huge land assets, it charged.

Searches also confirmed the "bogus" nature of Vigilance Security Services Pvt. Ltd. which was found non-existent at its declared addresses, the agency said.

The entity (Vigilance Security) declared a mere Rs 20 lakh as "revenue from operations" in its latest balance sheet whereas it reported assets worth Rs 64 crore mainly in the nature of long-term loans and advances, it said.

Since inception, the agency added, credit and debit transactions in the company's impugned bank account was found to be more than Rs 200 crore. Investigation found "indirect" control of Vivek over Vigilance Security, the agency said.

It said prima facie, FEMA contraventions have been detected against Vigilance Security Services Pvt. Ltd. and its parent company Yeshwant Realtors, whose majority shares are held by a foreign national.

Such prima facie violations were also noticed in the incorporation of an entity by Vivek in a foreign tax-haven country, the ED alleged.

Vivek and his wife own movable assets valued at Rs 377 crore, mostly shares in various companies, including his own Visaka Industries, which was founded in 1981.

The family's immovable assets stood at over Rs 225 crore.

Rajneesh Goel appointed as Karnataka's new Chief Secretary

The Karnataka government on Tuesday appointed senior IAS officer Rajneesh Goel as the next Chief Secretary, with incumbent Vandita Sharma due to retire at the end of November.

Mr Goel, a 1986-batch IAS officer, is currently the Additional Chief Secretary (ACS) in the Home Department of the Government of Karnataka.

In May this year, after the Congress government came to power, he was given concurrent charge of the post of ACS to Chief Minister Siddaramaiah.

"Dr Rajneesh Goel IAS, (KA:1986), Additional Chief Secretary to Government, Home Department, Government of Karnataka is appointed as Chief Secretary to Government of Karnataka" as the incumbent "Smt. Vandita Sharma IAS is retiring from service on superannuation on 30.11.2023," an official notification said.

कोचिंग सेंटर दोषी नहीं, पेरेंट्स की उम्मीदें बच्चों को जान देने के लिए कर रहीं मजबूर : छात्रों के सुसाइड पर SC

राजस्थान के कोटा के कोचिंग संस्थानों (Kota Students Suicide) में छात्रों की बढ़ती आत्महत्या की घटनाओं के लिए सुप्रीम कोर्ट ने उनके माता-पिता को जिम्मेदार ठहराया है. सुप्रीम कोर्ट (Supreme Court) ने कहा कि छात्रों के बीच बढ़ती आत्महत्याओं के लिए कोचिंग सेंटर्स (Coaching Institutes) को दोषी ठहराना उचित नहीं है, क्योंकि माता-पिता की उम्मीदें बच्चों को जान देने के लिए मजबूर कर रही हैं.

सुप्रीम कोर्ट ने सोमवार को यह टिप्पणी मुख्य रूप से राजस्थान के कोटा में छात्रों की बढ़ती आत्महत्याओं को लेकर की है. इस साल अब तक कोटा के अलग-अलग कोचिंग संस्थानों में 24 छात्रों के सुसाइड की खबरें आई हैं.

'समस्या अभिभावकों की है'
जस्टिस संजीव खन्ना की अध्यक्षता वाली दो जजों की बेंच ने प्राइवेट कोचिंग सेंटर को रेगुलेट करने और उनके लिए एक स्टैंडर्ड तय करने के लिए कानून बनाने की मांग करने वाली याचिका पर विचार करने से इनकार करते हुए ये टिप्पणी की. अदालत ने कहा, "समस्या अभिभावकों की है, कोचिंग संस्थानों की नहीं."

शीर्ष अदालत ने कहा कि ये नीतिगत मामला है. बच्चे अपने मां-बाप की उम्मीदों पर खरे नहीं उतर रहे हैं, जिस वजह से वो आत्महत्या कर रहे हैं. प्रतियोगी परीक्षाओं की तैयारी करने वाले बच्चों के बीच कड़ी प्रतिस्पर्धा और उनके अभिभावकों का दबाव आत्महत्या के बढ़ते मामलों की वजह है. 

डॉक्टर अनिरुद्ध नारायण मालपानी की याचिका पर हो रही थी सुनवाई
अदालत मुंबई के डॉक्टर अनिरुद्ध नारायण मालपानी की ओर से दायर एक जनहित याचिका पर सुनवाई कर रही थी. याचिका में कहा गया है कि कोचिंग सेंटर छात्रों को अपने फायदे के लिए तैयार करके मौत के मुंह में धकेल देते हैं. 

बेंच ने कहा, ''हममें से ज्यादातर लोग कोचिंग संस्थान नहीं चाहते, लेकिन आजकल परीक्षाएं इतनी प्रतिस्पर्धात्मक हो गई हैं और छात्र आधे या एक नंबर से परीक्षा में फेल हो जाते हैं. वहीं, माता-पिता को भी बच्चों से काफी उम्मीदें रहती हैं."

सुप्रीम कोर्ट ने याचिकाकर्ता को दिया सुझाव
सुप्रीम कोर्ट ने याचिकाकर्ता को सुझाव दिया कि वह मामले में या तो राजस्थान हाईकोर्ट का दरवाजा खटखटाए, क्योंकि याचिका में जिन आत्महत्याओं की घटनाएं का जिक्र है, उनमें अधिकतर कोटा से संबंधित हैं या फिर केंद्र सरकार को एक रिप्रेजेंटेशन दे. हम इस मुद्दे पर कानून कैसे बना सकते हैं? इस पर वकील प्रिया ने याचिका वापस लेने की अनुमति मांगी. उन्होंने संकेत दिया कि याचिकाकर्ता एक रिप्रेजेंटेशन पेश करना चाहेगा.

Supreme Court's Big Order On Extra-Territorial Pre-Arrest Bail Requests

In a significant verdict, the Supreme Court on Monday held that a high court or sessions court can grant anticipatory bail for a limited period to a person apprehending arrest in connection with an FIR registered outside their territorial jurisdiction, saying it was necessary to protect a citizen's right to life, personal liberty and dignity.

The top court in its order, having wide ramifications in criminal matters where accused apprehend arrests in cases lodged in other states, laid down several conditions for grant of such a relief.

“We are of the view that considering the constitutional imperative of protecting a citizen's right to life, personal liberty and dignity, the High Court or the Court of Session could grant limited anticipatory bail in the form of an interim protection under Section 438 of CrPC in the interest of justice with respect to an FIR registered outside the territorial jurisdiction of the said court,” a bench comprising justices B V Nagarathna and Ujjal Bhuyan said.

At the same time, it said such power to grant extra-territorial anticipatory bail should be exercised in exceptional and compelling circumstances.

The verdict came on an appeal of a woman challenging the grant of anticipatory bail by a Bengaluru local court to her estranged husband and his family members in connection with a dowry harassment FIR lodged at Chirawa Police Station at Jhunjhunu district in Rajasthan.

This gave rise to a legal question of whether a sessions court can grant anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with an FIR lodged outside its jurisdiction.

Answering in affirmative, Justice Nagarathna, in her 85-page judgment, laid down certain conditions for granting such a relief.

“Prior to passing an order of limited anticipatory bail, the investigating officer and public prosecutor who are seized of the FIR shall be issued notice on the first date of the hearing, though the court in an appropriate case would have the discretion to grant interim anticipatory bail,” it said.

The bench said the order of grant of “limited anticipatory bail” must record reasons as to why the applicant apprehends an inter-state arrest and the impact of such grant of limited anticipatory bail or interim protection, as the case may be, on the status of the investigation.

“The jurisdiction in which the cognisance of the offence has been taken does not exclude the said offence from the scope of anticipatory bail by way of a State Amendment to Section 438 of CrPC,” it said.

The person, seeking anticipatory bail, must satisfy the court regarding his inability to seek anticipatory bail from the court which has the territorial jurisdiction to take cognisance of the offence, it said.

The grounds raised by the applicant may be “a reasonable and immediate threat to life, personal liberty and bodily harm in the jurisdiction where the FIR is registered”, it said.

The person apprehending arrest will have to prima facie establish the violation of the right to liberty or impediments owing to arbitrariness and “the medical status/ disability of the person".

Dealing with the facts of the case, the bench took note of the social reality of “criminal complaints relating to dowry harassment, cruelty and domestic violence arising out of unsuccessful matrimonial relationships”.

“With the increasing migration of young people for marital and career prospects, supplemented by the forces of economic liberalisation, a significant number of couples hail from two different states, with the corollary being that the matrimonial home of a complainant-wife is located in a different state from where her parental home is located,” it said.

The judgment said it would be impossible to fully account for all exigent circumstances in which an order of extra-territorial anticipatory bail may be imminently essential to safeguard the fundamental rights of the applicant.

“We reiterate that such power to grant extra-territorial anticipatory bail should be exercised in exceptional and compelling circumstances only - which means where denying transit anticipatory bail or interim protection to enable the applicant to make an application under Section 438 of CrPC before a Court of competent jurisdiction would cause irremediable and irreversible prejudice to the applicant,” it said.

The court, while considering such an application for extra-territorial anticipatory bail, in case it deems fit may grant interim protection instead for a fixed period and direct the applicant to make an application before a court of competent jurisdiction, it said.

By this judgment, the top court set aside verdicts of the Patna High Court and the Calcutta High Court “to the extent that they hold that the High Court does not possess jurisdiction to grant extra-territorial anticipatory bail that is even a limited or transit anticipatory bail.” The judgement also answered a query with regard to jurisdiction.

The question was if a person commits an offence in one state and the FIR is lodged there, can he approach a court at his native place in another state seeking “transit anticipatory bail for a limited duration”? “We have held that the accused could approach the competent court in the State where he is residing or is visiting for a legitimate purpose and seek the relief of limited transit anticipatory bail although the FIR is not filed in the territorial jurisdiction of the District or State in which the accused resides, or is present depending upon the facts and circumstances of each case,” it held.

भारत और ऑस्‍ट्रेलिया के बीच क्रिकेट विश्‍व कप फाइनल (India vs Australia Final) देखने के लिए प्रधानमंत्री नरेंद्र मोदी (PM Narendra Modi) भी पहुंचे. इस मुकाबले में ऑस्‍ट्रेलिया ने भारत को छह विकेट से हरा दिया. पीएम मोदी ने शानदार जीत पर ऑस्‍ट्रेलिया को शुभकामनाएं दी हैं. साथ ही पीएम मोदी ने ऑस्‍ट्रेलिया के खिलाडी ट्रेविस हेड को उल्‍लेखनीय खेल के लिए बधाई दी है. उन्‍होंने भारतीय क्रिकेट टीम के विश्‍व कप हारने के बाद कहा कि हम आज और हमेशा आपके साथ खड़े हैं.

इससे पहले, पीएम मोदी और ऑस्ट्रेलिया के उप प्रधानमंत्री रिचर्ड मार्ल्स आईसीसी क्रिकेट विश्व कप फाइनल देखने के लिए अहमदाबाद पहुंचे. गुजरात के मुख्यमंत्री भूपेंद्र पटेल, राज्यपाल आचार्य देवव्रत और गुजरात के भारतीय जनता पार्टी प्रमुख सीआर पाटिल ने हवाई अड्डे पहुंचने पर मोदी का स्वागत किया. 

बता दें कि भारतीय टीम फाइनल में पहले बल्लेबाजी करते हुए 240 रन पर सिमट गई और ऑस्‍ट्रेलिया ने उसे छह विकेट से हरा दिया. मिचेल स्टार्क की अगुआई में गेंदबाजों के उम्दा प्रदर्शन के बाद ट्रेविस हेड के शतक से ऑस्ट्रेलिया ने आईसीसी क्रिकेट विश्व कप फाइनल में भारत को छह विकेट से हराकर लगातार नौवीं जीत के साथ अभूतपूर्व छठा एकदिवसीय विश्व कप जीता और साथ ही करोड़ों भारतीयों का दिल और मेजबान टीम का विश्व चैंपियन बनने का सपना तोड़ दिया.

Athlete Claims She Did Not Get Government Job, Meets Haryana Minister

A national-level woman athlete on Sunday claimed that she did not get a government job as per the sports policy of the Haryana government.

Renu Chhikara met Home Minister Anil Vij at his residence and sought his intervention in the matter.

The athlete from the Sonipat district had won a bronze medal in the national-level athletic competition two years ago.

Renu Chhikara claimed that even after two years, she has still not been given a job as per the outstanding sportsperson quota in the state's sports policy. Whereas 25 other players have got jobs.

According to norms of the quota, she should have been appointed to the post of coach in the sports department, Renu Chhikara said.

She said despite being eligible for this post, her application was rejected.

Mr Vij assured the player of all possible help and sent his application to the additional chief secretary of the sports department.
