"Can't Proceed On Assumption": Court Bail To Man In Money Laundering Case

The Delhi High Court today granted bail to Indore-based real estate developer Vijay Agrawal in a money laundering case involving alleged hawala dealer Naresh Jain, and said when an individual's liberty is concerned, it cannot proceed merely on the basis of assumptions and presumptions.

Justice Dinesh Kumar Sharma said there is no "absolute restraint" on the grant of bail under the Prevention of Money Laundering Act or a requirement of "positive finding qua guilt" at this stage.

The judge said there has to be some substantial link between the money received and criminal activity relating to scheduled offence, which can be attributed to the accused.

According to the Enforcement Directorate (ED), Naresh Jain along with his brother Bimal Jain and other accomplices hatched a criminal conspiracy to cause a loss to the exchequer and banks by indulging in illegal foreign exchange transactions on the basis of forged and fabricated documents.

The agency told the court that in furtherance of the conspiracy, Agrawal acquired shares of a company at a lesser price than actual valuation and also took loans from the shell companies of the co-accused.

The court observed the claim by Agrawal, who was arrested in March 2022, that he did not know he was dealing with tainted money cannot be brushed aside mechanically and granted him bail on a personal bond of Rs 25 lakh subject to conditions.

"For the purpose that evidence cannot be meticulously examined at this stage, the court cannot merely proceed on the basis of assumption. There has to be some substantial link between the money received and criminal activity relating to scheduled offence which can be attributed to the petitioner," said the court.

"The petitioner is stated to be renowned developer and his plea that he did not know that he is dealing with the tainted money cannot be brushed aside mechanically. If the liberty of an individual is concerned, the Court cannot proceed merely on the basis of assumptions and presumptions.. The twin conditions of Section 45 do not put an absolute restrain on the grant of bail or require a positive finding qua guilt," said the court.

In its order, the court stated while protecting the right and liberty of an individual, it has to consider the right of the society at large as well as the prosecuting agency as the offence of money laundering is a very serious offence which affects the financial health, integrity and sovereignty of the nation.

It however added the offence of money laundering is like a "running-goods train where the bogey keeps on adding" and the question to be examined is whether a person whose role is found later knew that the money which he has been dealing with is a proceed of crime and a finding cannot be returned "merely on the basis of inferences and presumptions".

The court added it cannot meticulously examine the evidence and cannot hold a mini trial at this stage as it has to only examine the case on the scale of broad probabilities.

The court noted in the present case, Agrawal was not an accused in the predicate offence and was also not named in the ED FIR. He also suffered from a serious medical condition, it said.

"Thus taking into account the facts and circumstances, the petitioner is admitted to bail on furnishing a personal bond in the sum of Rs.25,00,000/- (Rupees Twenty-Five lakhs) with two sureties of the like amount to the satisfaction of the trial court, subject to the conditions," ordered the court.

The ED has alleged that Naresh Jain and his accomplices were operating around 337 accounts in foreign banks in Dubai, Hongkong and Singapore in respect of 104 shell firms/ companies.

It claimed before the high court that during the investigation, 603 bank accounts of 311 companies have been examined and it has been gathered that Naresh Jain and his accomplices rotated funds approximately to the tune of Rs 96,000 crore for providing accommodation entries of approximately Rs 18,679 crore to 973 beneficiaries.

Siddaramaiah's "Need For New Parliament" Query Amid Wrestlers' Detention

Karnataka Chief Minister Siddaramaiah questioned the need for a new Parliament building after protesting wrestlers were detained by the police on Sunday for demanding justice.

Security personnel stopped and detained protesting wrestlers as they try to march towards the new Parliament building from their site of protest at Jantar Mantar in Delhi.

In a tweet, the Karnataka Chief Minister said, "What's the need for the new Parliament building if it can't give justice to the Wrestlers who are protesting? It is unfortunate to know that few wrestlers have been detained for demanding justice. We as humans and Indians should stand with them and voice their concerns. They had made Indians proud by winning medals for us and we should make them feel proud to be Indians!!"

The ongoing wrestler protest in the national capital has taken a new toll as star grappler Bajrang Punia said the Mahila Mahapanchayat will definitely take place in front of the new Parliament building which was inaugurated by Prime Minister Narendra Modi.

Several ace grapplers including Bajrang Punia, Vinesh Phogat and Sakshee Mallik have been protesting at the Jantar Mantar accusing the Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh of sexual harassment and demanding his arrest.

Wrestlers were trying to march towards the new Parliament as they want to hold a women's Maha Panchayat in front of the new Parliament.

"Democracy is being killed in the country, no one is getting the justice they deserve," Bajrang Punia told reporters ahead of the protesting wrestlers' march towards the new Parliament building.

Mr Punia said, "Many people are very cooperative with us but there are few police officials who are misbehaving with us, they are not allowing our family members to go inside."

Asked about whether the Mahapanchayat will take place or not, the 29-year-old wrestler said, "Mahapanchayat will definitely take place. We have given a letter to seek permission. Police are just making a fool out of us and are constantly keeping us under pressure."

Without naming Wrestling Federation of India (WFI) president Brij Bhushan Sharan Singh, Punia said, "The one, who is accused of offences, is roaming freely. He banters about changing the law, defaming POCSO (Protection of Children from Sexual Offences) Act controlling the government, no harm is done to that person, whereas, those who are peacefully protesting are getting ill-treated."

Further attacking WFI chief Brij Bhushan Sharan Singh, Bajrang Punia said, "He is only doing politics, he wants to change the POCSO Act."

Bajrang Punia stated that about 2,500 persons have been detained by police.

"Police are camping at the home of our coaches, players, and leaders of Kisan Union and Khap Panchayat. Whether it be Haryana, Punjab, Uttar Pradesh, or Rajasthan," he said.

"I request to the government and to the police department to release our people who have been detained because we want to establish this as a peaceful protest and carry it on in the same manner. We are protesting for the self-respect of our sister and daughter, we are not protesting for any political motive," the Olympic Bronze medalist added.

'ऑनर किलिंग': पाकिस्तान के पंजाब प्रांत में युवती को जिंदा जलाया

लाहौर: पाकिस्तान के पंजाब प्रांत में एक युवती को जिंदा जलाने का मामला सामने आया है. पुलिस ने रविवार को यह जानकारी दी है. पुलिस ने बताया कि यह मामला झूठी शान की खातिर हत्या (ऑनर किलिंग) का है. पुलिस ने बताया कि यह घटना शुक्रवार को लाहौर से लगभग 200 किलोमीटर दूर झंग जिले के गढ़ महाराजा में हुई.

जांच अधिकारी मोहम्मद आजम ने रविवार को ‘पीटीआई-भाषा' को बताया कि रजाब अली ने अपने बेटों जब्बार और आमिर और परिवार के कुछ अन्य सदस्यों के साथ मिलकर 26 मई को अपनी 20 वर्षीय बेटी को घर में आग लगाने से पहले बुरी तरह प्रताड़ित किया.

पुलिस अधिकारी ने बताया कि युवती अपनी पसंद के व्यक्ति से शादी करना चाहती थी. उन्होंने कहा, ‘‘एक दिन पहले, वह घर से चली गई थीं और ऐसा बताया जाता है कि लौटने से पहले उस व्यक्ति के साथ कुछ समय बिताया था.'' आजम ने बताया कि उसके लौटने पर उसके पिता, दो भाइयों और परिवार की कुछ महिलाओं ने उसे रस्सी से बांध दिया और आग लगाने से पहले युवती को बुरी तरह से प्रताड़ित किया.

उन्होंने बताया कि पीड़िता को अस्पताल ले जाया गया जहां उसकी मौत हो गई. उन्होंने कहा, ‘‘मरने से पहले उसने पुलिस को आग लगाने वालों के बारे में बताया था. पुलिस ने पीड़िता के पिता, दो भाइयों और एक बहन को गिरफ्तार कर लिया है. आरोपियों के खिलाफ हत्या का मामला दर्ज किया गया है." अधिकारी ने कहा कि गिरफ्तार किये गये आरोपियों को अपने इस कृत्य पर कोई पछतावा नहीं है और उनका कहना है कि लड़की ने परिवार के सम्मान को ठेस पहुंचाई है.

"No Central Discrimination Against Bengal": BJP State Chief

West Bengal BJP president Sukanta Majumdar on Sunday asserted that Chief Minister Mamata Banerjee's "pet phrase" of central discrimination against the eastern state was wrong as facts and figures show the opposite.

Mr Majumdar, while presenting the nine-year "report card" of the BJP government at the Centre, said that from constructing roads to providing water connection to households, the Narendra Modi government has always helped the state.

Sukanta Majumda claimed that even though the faulty land policy of the TMC government prevented land acquisition for highway expansion, the Centre never plugged the fund flow for building new highways in the state.

"Take the example of the slow pace of widening of National Highway 34. While it takes only five hours to reach Lucknow from Delhi, it takes around a whole day to reach Balurghat from Kolkata. Why is it so? There is no central discrimination in this," he said.

Majumdar said he wants the state to be known as a place of job-givers and not job-seekers.

"There is only one fully functional airport in the state. Andal has very few flights and the Centre has sanctioned Rs 1,884 crore for the expansion of Bagdogra airport," he said.

Mr Majumdar said the state government never acknowledged the Centre's help in developing medical colleges in the state, including AIIMS, Kalyani.

He, however, praised the state for cooperating with the Centre in child immunisation.

BJP state spokesperson Samik Bhattacharya said, "Our efforts in presenting our rich ancient history are shown as saffronisation effort in some quarters and this perception should change."

दिल्ली पुलिस ने पहलवानों के खिलाफ दंगा करने समेत कई धाराओं में दर्ज किया मामला

नई दिल्ली: एक तरफ PM मोदी आज नई संसद भवन का उद्घाटन कर रहे हैं तो वहीं दूसरी ओर जंतर-मंतर पर धरना दे रहे प्रदर्शनकारी पहलवान नई संसद की ओर बढ़े रहे थे. लेकिन उन्हें कुछ ही देर बाद दिल्ली पुलिस ने हिरासत में ले लिया. वहीं, अब दिल्ली पुलिस ने पहलवानों के खिलाफ दंगा करने, गैरकानूनी जमावड़ा करने, ड्यूटी के दौरान पुलिस के काम में बाधा डालने के आरोप में केस दर्ज किया है, जिसके बाद प्रदर्शन कर रहे पहलवानों की मुश्किलें बढ़ सकती है.

 जानकारी के अनुसार जंतर-मंतर पर कुछ पहलवान वापस पहुंचे थे. लेकिन दिल्ली पुलिस ने उन्हें प्रदर्शन की इजाजत नहीं दी और वापस भेज दिया. दिल्ली पुलिस मे पहलवानों के खिलाफ आईपीसी की धारा 147, 149, 186, 188, 332, 353 के तहत केस दर्ज किया है. पीडीपीपी अधिनियम की धारा 3 में भी FIR दर्ज किया गया है. दिल्ली पुलिस ने जंतर मंतर को पूरी तरह से खाली करा लिया है. जंतर-मंतर से पहलवानों के अलावा सभी प्रदर्शनकारियों को हटाया गया. पहलवानों के टेंट और अन्य सामान को भी हटाकर जंतर मंतर को साफ किया गया.

एथलीट यौन उत्पीड़न और डराने-धमकाने के आरोपों को लेकर भारतीय कुश्ती महासंघ के अध्यक्ष बृज भूषण सिंह की गिरफ्तारी की मांग कर रहे हैं. WFI  के अध्यक्ष बृजभूषण शरण सिंह के विरोध में पहलवानों द्वारा आज दिल्ली में 'महिला सम्मान महापंचायत' का आह्वान किया गया था. जिसको लेकर दिल्ली में कड़े सुरक्षा बंदोबस्त किए गए. दिल्ली पुलिस के स्पेशल सीपी ने कहा कि पहलवानों को हमने पहले कहा था कि आज कोई राष्ट्रविरोधी काम न करें, लेकिन उन्होंने हमारी बात नहीं मानी. हमने सभी को डिटेन कर लिया है और जंतर मंतर खाली करा दिया है.

BSF ने गुजरात तट के द्वीपों से संदिग्ध मादक पदार्थ के पांच पैकेट बरामद किए

अहमदाबाद: सीमा सुरक्षा बल (BSF) ने रविवार को गुजरात के कच्छ जिले में जखाऊ तट के दो द्वीपों से संदिग्ध मादक पदार्थ के एक-एक किलोग्राम के पांच पैकेट बरामद किए. बीएसएफ के एक अधिकारी ने यह जानकारी दी है. अधिकारी ने कहा कि ताजा बरामदगी के साथ इस साल अप्रैल से समुद्र तट के किनारे पाए गए ऐसे पैकेट की संख्या 41 हो गई है.

बीएसएफ के गुजरात फ्रंटियर की ओर से जारी एक विज्ञप्ति के अनुसार, दिन के दौरान जखाऊ तट के पास दो अलग-अलग द्वीपों से संदिग्ध मादक पदार्थ के पांच पैकेट बरामद किए गए. जखाऊ तट से लगभग आठ किलोमीटर दूर लूना बेट द्वीप से एक पैकेट बरामद किया गया, जो पहले बरामद किए गए चरस के एक पैकेट के समान था और इसे प्लास्टिक की थैली में पैक किया गया था, जिस पर 'अफगान उत्पाद' शब्द छपा था.

जानकारी के अनुसार अन्य पैकेट जखाऊ तट से लगभग चार किलोमीटर दूर खिदरत बेट द्वीप से बरामद किए गए और इनमें से एक पैकेट पहले बरामद किए गए हेरोइन के पैकेट जैसा था. बरामद मादक पदार्थ की प्रकृति का पता लगाने के लिए फॉरेंसिक विश्लेषण किया जा रहा है.

"Shameful": Mamata Banerjee On Protesting Wrestlers' Detention

West Bengal Chief Minister Mamata Banerjee on Sunday condemned the detention of wrestlers protesting at Jantar Mantar in New Delhi, asserting that "democracy lies in tolerance but autocratic forces thrive on intolerance and quelling of dissent".

She demanded that the protesting wrestlers, including Vinesh Phogat, Sakshi Malik and Bajrang Punia, be released immediately.

"Strongly condemn the way Delhi Police manhandled Sakshi Malik, Vinesh Phogat and other wrestlers. It's shameful our champions are treated in this manner.

"Democracy lies in tolerance but autocratic forces thrive on intolerance and quelling of dissent. I demand they be immediately released by police. I stand by our wrestlers," Ms Banerjee said on Twitter.

In what could bring about a forceful end to the wrestlers' protest at Jantar Mantar, the Delhi Police, earlier in the day, detained Vinesh Phogat, Sakshi Malik and Bajrang Punia for violation of law and order after they breached the security cordon while trying to move towards the new Parliament building for a planned women's 'Mahapanchayat'.

Immediately after the wrestlers were pushed into buses and taken to different unknown locations, the police officers began clearing the protest site by removing the cots, mattresses, coolers, fans and the tarpaulin ceiling along with other belongings of the wrestlers.

The agitating wrestlers, including likes of Olympic medallists Punia, Sakshi and Asian Games gold winner Vinesh, have been demanding the arrest of outgoing Wrestling Federation of India president Brij Bhushan Singh who they have accused of sexually harassing several women grapplers.

The wrestlers had said that the use of force by police would not deter them from going ahead with their peaceful march and the Mahapanchayat.
