"Law Of Land": Supreme Court On Its Verdicts

The Supreme Court on Tuesday said the judgments delivered by it are the "law of the land" and there is no question of anyone violating the principles laid down in the verdicts.

The court made these observations while hearing a matter relating to the compliance of its July last year verdict, in which it had passed several directions, including that the Centre may consider the introduction of a separate enactment in the nature of a bail Act so as to streamline the process of grant of bail.

"A judgment of this court, including the one in Antil's case (in which the July 2022 verdict was delivered), is the law of the land. There is no question of anyone violating the principles laid down. Suffice for us to say that wherever this judgment is applicable, the principles have to be followed," a bench of Justices SK Kaul and A Amanullah said.

The court said apparently, there is a large number of cases arising, especially in Uttar Pradesh, where the grievance is that verdicts are not being followed.

"We consider appropriate that this order should be placed before the chief justice of the Allahabad High Court to ensure that there is sufficient dissemination of information...," it said.

The top court said it is not inclined to entertain applications in individual cases where it is stated that a judgment is not being followed.

"We also make it clear that henceforth, we will not entertain any such applications and the registry should not list any such applications before us as the purpose of keeping this matter alive is only to see that the implementation takes place in the larger perspective," it said.

Dealing with the aspect of compliance, the bench said it is for the high courts to ensure that wherever there is non-compliance, necessary steps are taken to ensure compliance.

In its order passed in the matter on March 21, the court had observed that it was the high courts' duty to ensure that the subordinate judiciary under their supervision follows the law of the land and if orders are being passed by magistrates in breach of its judgment, "it may even require judicial work to be withdrawn and those magistrates to be sent to the judicial academies for upgradation of their skills for some time".

During the hearing on Tuesday, an order passed by a sessions judge in Uttar Pradesh rejecting an anticipatory bail plea was placed before the top court bench.

The court noted that the order was passed in a matrimonial dispute where it was alleged that the complainant was assaulted and the husband and other members of his family were sought to be roped in.

The bench noted that it was stated before the court that the applicants were not arrested during the investigation and now, the chargesheet has also been filed.

Referring to the session court's order, the bench observed: "Certainly, the judge concerned meets the parameters for upgradation of skills in a judicial academy and the needful be done by the high court." The bench, which also dealt with several other issues related to the matter, posted it for further hearing in July.

In its judgment delivered in July last year in the case of Satender Kumar Antil vs CBI and another, the court passed several directions, including that bail pleas ought to be disposed of within a period of two weeks except if the provisions mandate otherwise, with the exception being an intervening application.

It had said applications for anticipatory bail were expected to be disposed of within a period of six weeks, with the exception of any intervening application.

Prior to that, in another order passed in October 2021, the court had issued guidelines for granting bail after the filing of the chargesheet and said trial courts were not precluded from granting interim relief, considering the accused's conduct during the probe.

Chargesheet Filed In Case Against Gujarat Conman Who Posed As PMO Official

The Jammu and Kashmir Police on Tuesday filed a charge sheet against alleged conman Kiran Patel who was arrested for posing as a senior PMO official and enjoying security cover, officials said.

The charge sheet against Patel, who is currently lodged in the Central Jail here, was filed in the court of the Chief Judicial Magistrate in Srinagar.

The fraudster, hailing from Gujarat, was arrested for allegedly posing as an additional director (strategy and campaigns) in the Prime Minister's Office (PMO) and enjoying many perks, including a bulletproof car and security cover besides other hospitality, police said.

Patel had claimed that he had been given a mandate by the central government to identify buyers for apple orchards in south Kashmir, they added.

A case under relevant sections of cheating and forgery was registered against him on March 2 and he was nabbed the next day from a five-star hotel here during his third visit to the Valley.

Four FIRs related to cheating were recently registered against Patel in different police stations in Gujarat, including one by the Ahmedabad crime branch for trying to usurp a senior citizen's bungalow.

पुराने जमाने में जब बोतल की सुविधा नहीं थी तो इसका ही इस्तेमाल करते थे. इसे छागल कहते हैं. कई जगहों पर इसका नाम दूसरा हो सकता है. आजकल ये एमेजन पर भी मिलने लगा है.

क्या है इसका काम

ये मोटे कैनवास से बना हुआ एक तरफ खुले मुंह वाला बैग है. इसे गांव-देहात में छागल कहते हैं. यात्रा के दौरान ये बहुत ही उपयोगी थैली होती थी. इसमें पानी भर के इसे कहीं भी खुली जगह पर छाया में टांग दिया जाता था. अंदर भरे पानी से इसमें नमी बनी रहती थी और बाहर चलने वाली गर्म लू से इसे ठंडक मिलती थी. 

यात्रा के समान में इसका खास महत्व हुआ करता था, इसे ट्रेन की खिड़की में बाहर की तरफ टांग दिया जाता था ताकि हवा से पानी शीतल बना रहे. ट्रक चालक इसे हमेशा अपने साथ रखते थे..

"Misunderstanding That Government Putting Pressure On Judiciary": Minister

Union Law Minister Kiren Rijiju on Tuesday said the Narendra Modi government has not done anything to undermine the judiciary's independence, and every institution should respect the 'Lakshman rekha' or boundary set by the Constitution.

Speaking at an event organised by the Bar Council of Maharashtra and Goa, he sought to refute the narrative that the government was exerting pressure on the judiciary.

"It is a misunderstanding that the government is trying to put any kind of pressure on the judiciary. We are not only maintaining the judiciary's independence but working to strengthen it," Mr Rijiju said.

"Some people who claim to be liberals are spreading this misunderstanding among people but it is not at all true," the minister added.

To the question whether the government was interfering in the functioning of the judiciary, Mr Rijiju in a lighter vein said a question could also be asked the other way around, whether the judiciary was interfering in the government's work.

"Our Constitution mandates a 'Lakshman rekha' for every institution and this line should be respected. Our government under the leadership of Narendra Modi has done nothing to undermine the judiciary's independence or interfere with the judiciary's work," the law minister asserted.

Increasing pendency of court cases is the biggest concern for the country and the solution lies in technology, he said.

"There are around five crore cases pending in our country. This means there is a delay in justice which in turn means five crore injustices are being done to the people of our country," he said.

The Supreme Court and Chief Justice of India DY Chandrachud are taking steps to promote online hearing and e-filing, the minister said.

"Some High Courts are, however, going slow on technology. I don't want to name as then it will become an insult for them," Mr Rijiju stated.

Budget for the judiciary is not an issue, he said.

"The Narendra Modi government has done everything to strengthen the judiciary. This is why even during the COVID-19 pandemic courts in India did not stop functioning," Mr Rijiju said.

The minister, an MP from Arunachal Pradesh, also said that "for my peace I derive inspiration from Lord Buddha" but "when it comes to fighting for someone's rights, then my source of inspiration is Chhatrapati Shivaji Maharaj."

The Modi government is a "Rashtravadi Raj" and only wants people not to forget their roots, he said.

"Learning a new language or speaking in English is fine but a person needs to think in their Hindustani language," he said, adding that Indian courts should start using local language.

Maharashtra Chief Minister Eknath Shinde, present at the event, urged Mr Rijiju to look into the proposal to rename the Bombay High Court as Mumbai High Court.

His government recently decided to allot land in suburban Bandra-Kurla Complex (BKC) for a new high court building and would also consider allotting land in neighbouring Thane district for an academy for law students, he said.

"We know how important the judiciary is. Whenever we get any requests for manpower or infrastructure (for judiciary) we pass the proposal without wasting any time," Mr Shinde said.

Non-Bailable Warrant Against 3 UP Professors Over 'Casteist Slurs': Cops

A non-bailable warrant has been issued against a professor and two former professors of the Allahabad University following a complaint from an assistant professor, police said here on Monday.

Deepshikha Sonkar, the assistant professor in the department of economics, got a case lodged in August 2016 against the then head of the department, Professor Prahlad Kumar, Professor Manmohan Krishna and Professor Javed Akhtar under sections 354C (voyeurism), 504 (intentional insult with intent to provoke breach of the peace) and 506 (criminal intimidation) of the Indian Penal Code (IPC) and provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act at the Karnalganj police station.

Assistant Commissioner of Police Shivkuti Rajesh Kumar Yadav said a non-bailable warrant has been issued against the three professors.

In her complaint to the police, the assistant professor had said Mr Kumar, Mr Krishna and Mr Akhtar had hurled casteist slurs at her and had also exploited her.

Public Relations Officer (PRO) of the university Jaya Kapoor said after his retirement, Krishna had become the chair professor of Niti Aayog at the university, Mr Kumar had retired, while Mr Akhtar is still a professor.

She added that Sonkar's complaint was taken seriously by the then vice-chancellor in 2016 and a probe committee was formed. The committee had found the complaint baseless, Ms Kapoor said, adding that Ms Sonkar did not answer the questions sent to her by the panel nor could she produce any evidence to corroborate her allegations.

एआर रहमान के कार्यक्रम को पुणे पुलिस ने कराया बंद, जानिए क्‍या था कारण

महाराष्ट्र के पुणे शहर में पुलिस ने ऑस्कर पुरस्कार विजेता संगीतकार एआर रहमान के एक कार्यक्रम को बंद करा दिया, क्योंकि यह रात 10 बजे की समय सीमा के बाद भी जारी था. एक अधिकारी ने सोमवार को यह जानकारी दी. रविवार को यहां हुए कार्यक्रम का एक वीडियो सोशल मीडिया पर ‘वायरल' हुआ, जिसमें एक पुलिस अधिकारी को मंच पर जाते और रहमान, अन्य कलाकारों तथा आयोजकों को संगीत कार्यक्रम बंद करने के लिए कहते देखा जा सकता है. पुणे में राजा बहादुर मिल्स परिसर में रहमान (56) के कार्यक्रम को देखने के लिए काफी संख्या में लोग एकत्र हुए थे. 

बंडगार्डन पुलिस थाने के निरीक्षक संतोष पाटिल ने बताया, ‘‘रात 10 बजे की समय सीमा पार हो जाने के कारण हमने उन्हें (रहमान को) और अन्य कलाकारों को कार्यक्रम बंद करने को कहा.'' वीडियो में देखा जा सकता है कि पाटिल घड़ी की ओर संकेत करते हुए रहमान और अन्य कलाकारों को कार्यक्रम बंद करने के लिए कह रहे हैं. 

पुलिस के एक वरिष्ठ अधिकारी ने बताया कि इस सिलसिले में कोई मामला दर्ज नहीं किया गया है. 

रहमान ने सोमवार को एक ट्वीट में कहा कि कार्यक्रम के दौरान दिये गये प्यार और उत्साह प्रदर्शित करने के लिए पुणे का शुक्रिया. हालांकि, उन्होंने घटना का जिक्र नहीं किया.

रहमान ने ट्वीट में कहा, ‘‘बीती रात दिये गये आपके प्यार और प्रदर्शित किये गये उत्साह के लिए आपका शुक्रिया, पुणे! क्या शानदार कार्यक्रम था! हम आपके साथ फिर से गाने के लिए जल्द ही दोबारा वापस आएंगे.''

हालांकि, रहमान के एक सहयोगी ने कहा कि पुलिस पद्म भूषण से नवाजे जा चुके रहमान की ओर इशारा करने के बजाय कार्यक्रम के आयोजकों से बात कर सकती थी.

सहयोगी ने कहा, ‘‘रात दस बजे की समय सीमा थी, लेकिन उन्होंने कहा कि यह अंतिम गीत है और केवल एक मिनट बचा है. पुलिस अधिकारी मंच पर चढ़ गए और रहमान की ओर इशारा करते हुए इसे बंद करने को कहा. पुलिस आयोजकों से बात कर सकती थी.''

कार्यक्रम के आयोजक डॉ हेराम्ब शेल्के ने कहा कि इस तरीके से कार्यक्रम बंद कराना रहमान के लिए असम्मानजनक है और यह अच्छे व शिष्ट तरीके से कराया जा सकता था. 

उन्होंने कहा, ‘‘अंतिम क्षणों में ऐसा नहीं होना चाहिए था, क्योंकि पूरा कार्यक्रम सुव्यवस्थित था.''

Dismissed Delhi Police Constable Arrested For Impersonating Cop

A dismissed Delhi Police constable was arrested for allegedly posing as an on-duty policeman to demand money from people citing exigencies only to get away with the amount, officials said on Monday.

The accused has been identified a Rohit, a resident of Jhajjar in Haryana, they said.

He was previously involved in seven cases, mostly of cheating. Rohit was selected as a Delhi Police constable in 2016 and was dismissed from service in 2021 for allegedly indulging in criminal activities, a senior police officer said.

Recounting how he was defrauded, Complainant Satendar Singh, 55, a taxi driver from New Usmanpur, said the incident took place on Sunday when he was waiting at the Faridabad bus stand, opposite to the Kashmeri Gate ISBT.

Around 1.30 pm, the accused, who was wearing a khaki pant, a belt with Delhi Police monogram, black shoes and a casual shirt, introduced himself as a Delhi Police officer on duty at the police booth near Faridabad bus stand, the senior officer said.

Rohit told Mr Singh that he needed Rs 10,000 as he has to transfer the amount to someone urgently. He also told the complainant that he will return in cash. The complainant said he had only Rs 5,000 with him. Rohit provided a QR code and Singh paid Rs 5,000 to him after scanning the Quick Response (QR) code, Deputy Commissioner of Police (North) Sagar Singh Kalsi said.

"When Singh asked for the cash, Rohit started making excuses. After sometime, he told the complainant that if he does not trust him, he can keep his mobile phone until he returns the money, but the complainant refused the proposal. Later, the accused started running from the footover bridge towards ISBT," the DCP said.

The complainant informed Assistant sub-inspectors (ASIs) Virender Tiwari and Bal Hussain, who were patrolling near the entry gate of ISBT, about the incident after which the police personnel chased and nabbed the accused inside the ISBT, Mr Kalsi said.

The accused disclosed that he was selected as a constable in the Delhi Police in 2016. He started playing online game and got addicted to gambling. In 2021, he was dismissed from the service for his involvement in cheating cases, police said.

He mostly targeted gullible people like auto-rickshaw drivers, vendors and hawkers. He introduced them as a Delhi Police personnel. After showing urgency to the target and convincing them to get the money transferred to the bank account which he provided to them, he used to escape from the spot, police said.

One mobile phone, belt carrying Delhi Police monogram, khaki pant and black shoes which he was wearing at the time of the incident were also recovered from the accused, police added.
