Court Tells Tax Department To Reply On Kapil Sibal's Challenge To Notice

The Delhi High Court on Thursday restrained the Income Tax Department from proceeding further on the show cause notice issued to Rajya Sabha MP and senior advocate Kapil Sibal in relation to the assessment proceedings pending against him.

A bench of Justice Rajiv Shakdher and Justice Tara Vitasta Ganju issued a notice and asked the income tax authorities to file a response on the petition of the former Congress leader.

"We are of the view that since the impugned notice has been challenged on jurisdiction as well as on the breach of principles of natural justice, it would require some amount of deliberation," the bench said.

"In the meanwhile, the concerned officer will stay his hands vis-a-vis the show cause notice of March 11, 2023," it added.

The court listed the matter for further hearing on September 14 and asked the officer concerned to first deal with the objections of Mr Sibal.

Kapil Sibal has challenged the notice issued by the IT department under Section 153C of the Income Tax Act concerning (assessment year) AY 2013.

Senior advocate P Chidambaram, who was representing Mr Sibal, said the authorities seemed to be in great haste to conclude the assessment proceedings.

He said a search concerning the World Window Group was conducted in May 2018 and in so far as Mr Sibal was concerned, the notice under Section 153C of the Act was issued six years later in May 2021.

"Pursuant to the said notice, the petitioner (Sibal) filed his return on June 16, 2021. A request was made on November 3, 2021 seeking a copy of the satisfaction note and reasons/material based on which the notice under Section 153C had been issued. This request was reiterated by petitioner on March 1, 2023," Mr Chidambaram said.

He said the satisfaction note was furnished to Kapil Sibal on March 9 this year and material or reasons were furnished to him on March 10.

The counsel for the IT authorities said the officer concerned can proceed further on the basis of the material brought to his notice.

Assam Man, 42, Dies After Elephant Attack, Minor Son Hospitalised

A 42-year-old man was trampled to death by a wild elephant in Nagaon district of Assam, a senior official said on Wednesday. His minor son sustained critical injuries in the attack, he said.

According to the senior district administration official, the incident took place at Rekapahar Reserve Forest area in Kaliabar sub-division of the district on Tuesday when the father-son duo was returning home on a bicycle.

"They were suddenly attacked by the wild elephant, which came out of a nearby jungle," the official said.

After getting information, forest and police officials reached the spot, and rushed them to Nagaon Civil Hospital, where doctors declared the 42-year-old man dead, he said.

The minor son is undergoing treatment at a local hospital, the official added.

दिल्ली में आम आदमी पार्टी आज शुरू करेगी 'मोदी हटाओ, देश बचाओ' अभियान

आम आदमी पार्टी (AAP) ने 2024 के लोकसभा चुनाव का बिगुल फूंकते हुए कहा कि वह गुरुवार को यहां जंतर-मंतर से 'मोदी हटाओ, देश बचाओ' अभियान की शुरुआत करेगी. 'आप' नेता एवं दिल्ली के पर्यावरण मंत्री गोपाल राय ने बुधवार को एक संवाददाता सम्मेलन में कहा कि पार्टी एक आम बैठक आयोजित करेगी जिसमें दिल्ली के मुख्यमंत्री अरविंद केजरीवाल और पंजाब के मुख्यमंत्री भागवंत मान समेत कई वरिष्ठ नेता हिस्सा लेंगे.

गोपाल राय ने कहा, ‘‘ देश के महान स्वतंत्रता सेनानियों शहीद भगत सिंह, राजगुरु और सुखदेव के शहादत दिवस पर आयोजित इस बैठक के लिए पार्टी कार्यकर्ता और समर्थक इकट्ठे होंगे. आम आदमी पार्टी इस बैठक के दौरान 'मोदी हटाओ, देश बचाओ' नामक अभियान शुरू करेगी.''

यह घोषणा ऐसे समय की गई है जब एक दिन पहले ही राष्ट्रीय राजधानी में दीवारों और बिजली के खंभों पर 'मोदी हटाओ, देश बचाओ' लिखे हुए पोस्टर दिखाई दिए थे. दिल्ली पुलिस ने इस सिलसिले में छह लोगों को गिरफ्तार कर 49 प्राथमिकी दर्ज की हैं.

गोपाल राय ने कहा, ‘‘ प्रधानमंत्री को 'मोदी हटाओ, देश बचाओ' जैसे नारों के दीवारों पर लिखे जाने से डर लग रहा है. अब देश के लोगों की आवाज को पुलिस द्वारा गिरफ्तारियों और प्राथमिकी दर्ज करने से नहीं दबाया जा सकेगा. ''

राष्ट्र-विरोधी तत्व पंजाब में अशांति फैलाने का प्रयास कर रहे हैं जो चिंता का विषय : पूर्व कानून मंत्री अश्विनी कुमार

पूर्व कानून मंत्री अश्विनी कुमार ने बुधवार को कहा कि राष्ट्रविरोधी तत्व पंजाब में अशांति फैलाने का प्रयास कर रहे हैं जो चिंता का विषय है. उन्होंने सभी राजनीतिक दलों से एकजुट होकर कार्य करने का अनुरोध किया. राज्य में हालिया घटनाक्रम पर उन्होंने कहा कि भारत की एकता एवं अखंडता को राजनीतिक महत्वाकांक्षा का बंधक नहीं बनाया जा सकता है. कुमार की यह टिप्पणी ऐसे वक्त में आई है जब पंजाब पुलिस ने अलगाववादी अमृतपाल सिंह और उसके संगठन ‘वारिस पंजाब दे' के सदस्यों के खिलाफ बड़ी कार्रवाई शुरू की है.

उन्होंने कहा, ‘‘चूंकि इस तरह की स्थिति राष्ट्रीय सुरक्षा के हित में सीमावर्ती राज्य में बड़ी मेहनत से हासिल की गई शांति को खतरे में डाल सकती है, इसलिए इस मामले में पक्षपातपूर्ण प्रतिक्रिया नहीं हो सकती है. सभी राजनीतिक दलों को राज्य और केंद्र सरकारों के प्रयासों का समर्थन करना चाहिए, जिनसे समझदारी से निपटने की उम्मीद है.'' कुमार ने कहा, ‘‘स्थिति से निपटने में कोई भी गलत कदम या राजनीतिक दलों का प्रयास का प्रयास इस अशांत स्थिति में राष्ट्र के लिए महंगा पड़ेगा. यह अस्सी के दशक में पंजाब में अलगाववादी आंदोलन का एक स्पष्ट सबक है.''

उन्होंने कहा कि पंजाब में हालात राष्ट्र विरोधी अलगाववादी तत्वों द्वारा उग्रवाद और अशांति को बढ़ावा देने के प्रयासों का संकेत दे रहे हैं जो गंभीर चिंता का विषय है.

Indian Army Chief Highlights Lessons Learnt From Ukraine War

Army Chief Gen Manoj Pande on Wednesday highlighted the lessons learnt by Indian forces from the Russia-Ukraine conflict including the incidents like the sinking of Russian warships by Ukrainian anti-ship missiles.

"The sinking of Moskva, with likely use of anti-ship cruise missiles, highlights that even in the maritime domain, weapon platforms are more vulnerable than ever to low-cost defensive systems," said the Army Chief.

Speaking at Def-Tech India Conference in New Delhi, he discussed important aspects of 'India's Territorial Capabilities and Technology Requirements.'

"Information operations assumed a whole new dimension, being unfolded at multiple levels, through numerous tools and different domains. Competencies and dedicated strategies must also be in place to win the war of narratives," said Gen Manoj Pande.

He said that the ongoing Russia-Ukraine conflict provides valuable pointers and stressed hard power, duration of the war, precision fires, information operations and grey-zone aggression.

"Firstly, the relevance of 'Hard Power' stands reaffirmed with Land continuing to be the decisive domain of warfare and the 'Notion of Victory' still being land centric. Suppositions on the 'duration of war' need to be re-evaluated. 'Short swift war' may prove to be a flawed assumption and we need to be prepared for a full spectrum conflict, for even a prolonged duration. Long-range Precision Fires have proved that distance does not guarantee safety. Information operations assumed a whole new dimension, being unfolded at multiple levels, through numerous tools and different domains. Grey Zone aggression is increasingly becoming a preferred strategy of conflict prosecution with its scope enhanced by technological advancements. We need capabilities to not just negate or mitigate such attacks, but instead keep the adversary in a reactive mode perpetually," said the Army Chief.

Gen Pande also said air power no longer remains the exclusive preserve of manned aircraft.

"Air no longer remains the exclusive preserve of manned aircraft. The proliferation of Drones, Loiter Munitions, advanced VSHORADS and Manned-Unmanned Systems have democratized the air littoral. Air Superiority and even a Favourable Air Situation, are extremely difficult to achieve," he said.

Disruptive and dual-use technologies are reducing the asymmetry of conventional ratios. The advancements range from weaponization of commercial instruments, digital resilience, communications redundancy, expansion of conflict domains effectively into the Cyber, Space and Electromagnetic spectrum, making battlefield dangerously transparent and introducing niche systems & advanced kinetic weapons, have emerged as the new strategic arena of geo-political competition, with power plays focusing on technology denials.

"Our existing inventory has a fair mix, in terms of vintage and theatre-specific requirements. The pursuit to infuse technology into our warfighting systems remains an enduring one," said Gen Pande.

Speaking about the profound lessons that India has learnt from the ongoing war he stressed the importance of self-reliance in the defence sector and called for the infusion of technology into warfighting systems.

"Our transformation has as its edifice, five pillars - one of which is Modernization & Technology Infusion. Under this endeavour, major initiatives are underway to transform ourselves into a modern, technology-driven, Atmanirbhar and battle-worthy force, so that we can execute our operational mandate, more effectively," said the Army Chief.

BJP "Stoking Fear In Minds Of Hindus For Political Gains": Tejashwi Yadav

Bihar Deputy Chief Minister Tejashwi Yadav on Tuesday launched a fresh attack on the BJP inside the state assembly where he charged the opposition party with stoking "fear in the minds of Hindus" for political gains.

Tejashwi Yadav was replying to the debate on budgetary allocation for the health department, a portfolio that he holds, amid a walkout by the BJP on the second consecutive day.

"I had said a lot yesterday and I had hoped that the opposition leaders will be around today to take the debate forward. But they chose to run away. They have not even moved a cut motion. I will say something about them towards the end of my statement," Mr Yadav told the Chair before launching into a speech that ran for over 20 minutes.

Outside the assembly, Leader of the Opposition Vijay Kumar Sinha insisted that the walkout followed "the government's refusal to entertain a host of issues raised by us, including alleged involvement of a minister in a murder case and corruption cases against the Deputy CM himself".

"Chief Minister Nitish Kumar has surrendered before his new ally (RJD) and the state is reverting to the era of lawlessness from which we had pulled it out with so much of effort," alleged the BJP leader, whose party was stripped of power when Nitish Kumar snapped ties in August last year.

He also alleged that Speaker Awadh Bihari Chaudhary, who belongs to the RJD, had been running the House in a partisan manner.

When pointed out that Mr Yadav has sought an apology for having been proven wrong on allegations of attacks on migrants in Tamil Nadu, Sinha stood his ground saying "the report of the team of officials that toured that state should be tabled inside the House for discussion".

Inside the House, Mr Yadav ended his speech, after which the budgetary demand for the health department was passed by a voice vote, tearing into the opposition party.

"The BJP likes to thrive in a paradox wherein people shall remain happy as Hindus despite being unemployed and having to survive on five kilograms of free ration. Hindus comprise 85 per cent of the population and the BJP instils in them fear of the remaining 15 per cent so that they remain beholden to the party", said Mr Yadav.

Lalu Yadav, who had promised 10 lakh jobs to the state's youth, which helped him catch the public imagination in the 2020 assembly polls and propelled the RJD to the position of the single largest party, also told the House that the government was planning to provide employment to 1.6 lakh people in the health department itself.

"I am grateful to the Honourable Chief Minister who is present here and has fully supported me in fulfilling the promise of 10 lakh jobs. He has personally presided over a function where appointment letters were given to more than 10,000 recruits in the health department", the Deputy Chief Minister added.

He, however, made it clear that the government will not tolerate laxity on part of employees and pointed out that "action has been initiated against 700 doctors who have been absent from duty for long. In one cabinet meeting, termination orders were passed for 70 of such erratic officials".

He also disclosed that plans were afoot for an "emergency cadre" to ensure that patients do not suffer during unforeseen circumstances like strikes. In addition, a new "referral policy" was shaping up to put a check on the practice of doctors in other districts referring patients to Patna at the drop of a hat.

"We are also trying to put in place conditions wherein more and more medical facilities become available in various districts. This would further de-congest the hospitals in the state capital," said Lalu Yadav.

He also said that the government was sensitive to the fact that a large number of employees in the health department were women for the benefit of whom sanitary pad vending machines were being installed at hospitals.

"We are also considering a proposal to make these vending machines available to women admitted to the health centres," said the young leader.

Earthquake : अफगानिस्तान और पाकिस्तान में दहशत, लोग बिना जूते-चप्पल पहने बच्चों को लेकर भागे

Earthquake : अफगानिस्तान (Afghanistan) में आए तेज भूकंप के झटके पाकिस्तान के साथ भारत के भी कई इलाकों में महसूस किए गए. करीब 30 सेंकेड तक आए भूकंप की तीव्रता संयुक्त राज्य भूवैज्ञानिक सर्वेक्षण (United States Geological Survey) ने 6.5 आंकी है. काबुल के 50 वर्षीय निवासी खटेरा ने राजधानी में अपने पांच मंजिला अपाटमेंट से बाहर निकलने के बाद बताया, 'यह एक भयानक भूकंप था. मैंने अपने जीवन में पहले कभी ऐसा झटका महसूस नहीं किया था.' वहीं USGS ने कहा कि भूकंप पूर्वाेत्तर अफगानिस्तान में जुर्म के पास केंद्रित था और इसकी गहराई 187 किलोमीटर (116 मील) थी. 

यह क्षेत्र अक्सर भूकंपों से प्रभावित होता है - विशेष रूप से हिंदू कुश पर्वत श्रृंखला में, जो यूरेशियन और भारतीय टेक्टोनिक प्लेटों के मध्य में स्थित है. अभी तक किसी के हताहत होने या नुकसान की रिपोर्ट नहीं है, लेकिन भूकंप अफगानिस्तान, पाकिस्तान और यहां तक ​​कि भारत के कुछ हिस्सों में में भी महसूस किया गया.

पाकिस्तान के प्रधानमंत्री शहबाज शरीफ ने राष्ट्रीय आपदा प्रबंधन प्राधिकरण को किसी भी आपात स्थिति से निपटने के लिए तैयार रहने का आदेश दिया है.

भूकंप के समय अफगानिस्तान में कई परिवार फारसी नव वर्ष नवरूज का जश्न मना रहे थे. घर के अंदर रहने वाले भी जल्दी से अपने घरों और अपार्टमेंट से बाहर निकल आए. एएफपी के एक संवाददाता ने कहा, "वे बिना जूते पहने और अपने बच्चों को हाथों में लेकर भागे." 

अफगानिस्तान में पिछले करीब ढाई दशक में सबसे घातक भूकंप पिछले साल 22 जून को पक्तिका प्रांत में आया था. 5.9 तीव्रता के भूकंप के कारण 1,000 से अधिक लोग मारे गए थे और हजारों लोग बेघर हो गए थे. 

पिछले महीने दक्षिणपूर्वी तुर्की और सीरिया के कुछ हिस्सों में आए भूकंप से 55,000 से अधिक लोग मारे गए थे.
